kukajThe Clarkstown Police Department arrested a 20-year-old male suspect for allegedly passing a counterfeit $100 bill at the Shell Gas Station in Valley Cottage last Friday.

On May 13, 2016 at approximately 11:30 p.m., the Clarkstown Police Department received a call from the gas station owner stating that a possible counterfeit $100 bill was passed at the store. Responding officers apprehended Arber Kukaj, 20, of Valley Cottage.

The suspect attempted to buy lottery tickets with a counterfeit bill. Kukaj was in possession of the lottery ticket he had just purchased.

Kukaj was arrested, processed at police headquarters and charged with possession of a forged instrument in the second degree (felony) and petit larceny (misdemeanor).

He was arraigned in Clarkstown Justice Court. Bail was set at $10,000. He was transported to Rockland County Jail.

CPD warned the retail community: “This is another reminder that businesses should ensure their employees are trained to identify counterfeit currency.”

One of Senator Chuck Schumer’s aides to this area was arrested Monday afternoon for possession of about 200 anabolic steroid pills.

Cody Peluso, 32, of Carmel, Putnam County, was arrested following a traffic stop and charged with three counts of criminal possession of a controlled substance. He was also in possession of two pills of suboxone and one pill of xanax.

Peluso has been Senator Schumer’s Hudson Valley regional director for several years and earns $62,500 per year plus benefits. As of Tuesday, he was listed on the United States’ official government website as a current employee of Schumer’s.

Schumer’s office responded to the news of Peluso’s arrest, which was reported first by the Rockland County Times on www.rocktimes.com.

“We are shocked and saddened by this news. Mr. Peluso will immediately be placed on leave pending a complete investigation of this incident,” said Jason Kaplan, spokesman for Sen. Schumer

The traffic stop commenced when a license plate scan found the man’s vehicle registration was suspended. Police said Peluso also had his driver’s license revoked due to prior violations.

He apparently consented to a vehicle search during which police say they discovered the controlled substances.

His boss had earlier this year proposed $600 million in funding to fight heroin and other opiates. One of the controlled substances Peluso was allegedly found in possession of, suboxone, is a member of the opiate family, although it is most often prescribed to help addicts get off of heroin or oxycodone.

Convicted Rockland Murderer Patrick Bentz Granted Parole by State Panel

ROCKLAND COUNTY TIMES

A famous Rockland County murder may see one of its two assailants walk free if all goes according to schedule.

Kenneth Hiep, Sr. was discovered February 23, 1992 butchered and covered in debris in a ravine on Clausland Mountain in Blauvelt, New York. Hiep was successful in the trash business, but he also had mob ties. It was those ties that came back to end his life in the famous case that later inspired a book by then Rockland County Medical Examiner Frederick Zugibe.

Hiep was last seen with associate Charles Hemstreet and his employee Patrick Bentz at Lace cabaret in Blauvelt and another local bar. Lo and behold authorities found ample evidence tracing the case back to the pair, both mob connected, as well.

After a long appeal process due to prosecutorial mishandling of the case, both Bentz and Hemstreet were convicted of murder in the second degree. Hemstreet was sentenced to prison for 25 years to life and Bentz to a term of 23 years to life.

Now after serving his minimum sentence in state prison, Patrick Bentz has been paroled by a Board of three parole commissioners. He had been considered for early release a year prior.

Bentz is scheduled to be released from state prison on September 3, 2016, pending relocation approval from the Department of Corrections and Community Service. Hemstreet is not scheduled to be considered for parole until November 2019. Hemstreet is housed in Eastern Correctional Facility in Ulster County.

Bentz’s release is a continuation on what appears to be a pattern by the Department of Corrections to release convicted felons that have served long prison terms. With prisons claiming to be overcrowded and budgetary cuts in the Department of Corrections as well as continuing threats by Governor Cuomo to shut down more prisons, the strain on the prison system is at a critical level.

Bentz is currently housed in Woodbourne Correctional Facility in Sullivan County. Woodbourne is a medium-security prison, which means that Bentz has “earned” the privilege of being downgraded from a “maximum” security risk to a medium.

This was likely a factor in the Parole Board’s determination that his prison stint has been acceptable. Bentz still needs to make arrangements as to where he will reside once released. Currently, Department of Corrections officials are unaware as to where he intends to live once released.

Assault in the second degree, strangulation in the second degree and criminal contempt in the first degree, all felonies, are the charges faced by 43-year-old Suffern resident Emmanuel Jean Tenemille.

On Saturday May 28, 2016 at about 8:45 a.m., Ramapo PD were contacted by a 24-year-old female (name being withheld) who said that she had been assaulted a short while earlier in the wooded area behind the former Rockland Drive-In Theater on Rt. 59 in Monsey. The victim was transported to The Good Samaritan Hospital’s Emergency Room by Spring Hill Ambulance, where she was treated and released.

As a result of the investigation, Ramapo Police arrested Tenemille on the above charges. The victim said that she knew the suspect and that she could identify him. Ramapo Det. Sgt. Brian Corbett said “there is no known motive” for the attack at this time.

Tenemille was arraigned in the Village of Montebello Justice Court and remanded to the Rockland County Jail in lieu of $5,000 Bail.

NIGHTMARE ON CLARK ROAD: Mad Flasher strikes again

NIGHTMARE ON CLARK ROAD: Mad Flasher strikes again

Frank Chillino, 66, of 15 Clark Road in Stony Point, continued his long run of lewd behavior and other petty harassment of neighbors, getting arrested on Monday, Memorial Day, May 30 for taking a relaxing walk around his front yard completely in the nude.

Responding Stony Point PD officers said they saw the defendant walking around the outside area of his residence with his genitals exposed. Chillino was arrested for public lewdness, processed and released on appearance ticket returnable June 21.

This is at least the fourth time Chillino has been arrested on similar charges since 2010, earning himself the monicker “The Mad Flasher of Stony Point.” In June and November 2015 his most recent arrests for public lewdness occurred.

Neighbors have insisted his behavior is nothing to laugh at, describing him as mentally disturbed and increasingly erratic. Next-door neighbor Michele Squibb said she used to consider Chillino an eccentric but unthreatening neighbor, however, in recent years she has grown to fear him.

Following her husband’s passing in 2015, Chillino specifically had begun to act in a threatening and lewd manner toward Squibb, she told the Rockland County Times following Chillino’s 2015 arrest. Other neighbors said Chillino has been known to show up uninvited in their backyards snapping photos of their house.

He also was once known in the neighborhood for running strobe lights in his attic all through the night, as if hosting a disco party. Several neighbors have expressed the wish that Chillino’s family finds institutional residence for him before he hurts somebody or does something worse than merely expose himself and bother neighbors.

One neighbor told the Rockland County Times when Chillino was arrested in June, “I grew up living next to Mr. Chillino, and it has always been clear he may have struggled with mental illness. I am not saying that should be used as an excuse for his actions, but I am using it to point out that if that is causing his behavior, it is nothing to be made light of…Mr. Chillino is not only a menace to the people on Clark Road, but he has also been asked  to permanently stay away from businesses in North Rockland due to harassing customers…I’m sure after his recent arrest Mr. Chillino will behave himself for a little while, but I assure you, it will only be a matter of time before the nudity returns.”

Sister ShockLentini sibling says he’s capable of murder; wants him to stay behind bars

BY CAROL MCILMURRAY

*This article is based solely on Ashara Smith’s account of her brother Dylan Lentini, 19, and her recollection of the months leading up to Lentini’s move from Vacaville, California to New York.

DYLAN LENTINI’S SISTER SAYS SHE KNOWS IN HER HEART HE IS GUILTY: • Sister says she called cops on Lentini in June 2015 for breaking into their grandmother’s house at 3 a.m. while she was sleeping • Sister claims Lentini killed baby kittens over summer because they were not listening to him • Sister claims Lentini made other bad deals on Craigslist

DYLAN LENTINI’S SISTER SAYS SHE KNOWS IN HER HEART HE IS GUILTY:
• Sister says she called cops on Lentini in June 2015 for breaking into their grandmother’s house at 3 a.m. while she was sleeping
• Sister claims Lentini killed baby kittens over summer because they were not listening to him
• Sister claims Lentini made other bad deals on Craigslist

Ashara Smith, 21, is the half-sister of Dylan Lentini, 19, and says the two were raised together as a family with Lentini’s father, Vincent, being the only father she ever knew. Vincent and Stacey Lentini, went on to have one more child together before divorcing when Smith says she was about 14 years-old.

On Dec 1, 2015, Clarkstown police arrested Lentini and charged him with second-degree murder for the stabbing of Michael Wimbert, 66, a man Lentini is alleged to have met Wimbert for the first time on Craigslist’s Hudson Valley roommate wanted section.

Lentini claimed Wimbert made him engage in unwanted sex acts over the three-day stay at his West Nyack home and Lentini says he acted in self-defense when Wimbert woke him up from sleeping.

But according to Smith, “Dylan was playing that old man. He figured he would smoke weed all day and do whatever he wanted to do.”

“If anybody knows my little brother, it’s me, we shared bunk beds until I was 9 years old… He had the bottom bunk, I had the top,” said Smith. Smith continued, “One thing people don’t understand about my brother is he had absolutely nothing to lose.”

Smith says she fears for her life and she doesn’t want her brother to ever to get out of prison.

Lentini and sister as harmless children

Lentini and sister as harmless children

“I know in my heart he is guilty. Me and my mother were talking about it just a few months before it happened. We were wondering how long until he kills somebody,” said Smith.

“No amount of prison time is ever going to change him. He has been like this for as long I can remember. It’s sad to think about, he was this happy little baby and then when he was around two years old everything changed,” Smith said.

“He could get away with anything. He was really smart and he knew exactly how to manipulate people. He could be so charming, but when nobody was looking he was just evil,” Smith recalled.

If Smith could say one thing to her brother, it would be this, “You manipulated people your whole life, and then you killed those two baby kittens, and now you killed an old man! You killed an old man! I hope you feel terrible about yourself.”

And she does not buy for a second that he engaged in any sexual encounters with Wimbert. According to Smith, “No way he performed [oral sex] on that old man. You lay one finger on Dylan and he is the first one to call the cops!”

“When I heard my brother killed somebody, I wasn’t shocked, but when you tried to say that my brother might be bisexual that is when I said,

no way!” stated Ashara Smith.

Smith continued, “My brother is 100 percent straight, he was the type of guy who would always talk about females [in an overtly sexual way]. I would have to tell him, that’s gross! I am your sister, and I don’t want to hear you talk like that!”

TIMELINE TO CRAIGLIST KILLING; ACCORDING TO LENTINI’S SISTER

MARCH-JUNE 2015

Lentini moved to Carmicheal, California to live with their mother Stacey Lentini and her boyfriend in a one-bedroom apartment from the end of March until the end of June.

Lentini’s behavior drastically changed during this time and Smith suspects drug use. Smith says Lentini habitually smoked and sold marijuana since high school but she suspects harder drug use ‘like meth’ during this time.

Lentini brought home two kittens while living on his mother’s couch and had no plan to care for them or feed them.

Still from News12 trial coverage

Still from News12 trial coverage

Beginning of June, Smith says she calls cops on Lentini after he broke into their Grandmother’s house at 3 a.m. as Lentini broke into the sliding doors in the room Smith rented from her grandmother.  Smith says she was scared for her life since she was only person home while Grandmother was away on vacation. Smith says Dylan knew that was the room she rented, and he was acting out of sorts. Smith told Lentini to leave. Smith says Lentini got within an inch of her face and pushed her aside and turned on the television. Smith called cops and according to Smith Lentini made up a story on the spot about how Smith attacked him first. Cops made a call to Grandmother confirm Lentini was not welcome on property and after much heated debate, Lentini left the property.

JULY-AUGUST 2015

Lentini moved back in with his father in Vacaville, California. Lentini tries to put two kittens in his father’s car trunk for transport.

Lentini does not have a phone or Internet access. Lentini spent his days at the Vacaville public library looking at Craigslist ads on the Internet trying to buy things or get things for free and then sell them for money.

Lentini and his father are not getting along. They are fighting almost daily. Lentini allegedly kills two baby kittens and tells multiple family members it was because the kittens were not listening to him.

Lentini’s father kicks him out and gives him $5,000 from settlement money from a scooter accident as a child.

SEPT-DECEMBER 2015

Lentini had no place to call home and made a sudden and unannounced journey across the United States. Lentini makes a Craigslist deal for a car to travel cross-country.

A week later the car owner comes to Vincent Lentini’s home and knocks on the older Lentini’s door looking for the money. Family says he left town.

Dylan gets arrested in Utah and calls Grandma for bail money. Grandmother says she will not pay bail and family assumes he does time in a local jail. Smith assumed the arrest had to do with driving an unregistered car.

Smith says nobody in the family knows how he got to New York from Utah. Dylan Lentini’s Facebook account announces he is in Queens, New York on November 8.

In less than a month, Dylan Lentini responds to a craigslist ad posted by Michael Wimbert seeking a roommate in his West Nyack home. Dylan Lentini was telemarketing for Opinions Access Corp. in Queens, Ny and says he couldn’t afford to continue to live in the city and only had a $140 dollars to his name.

Lentini boards a train in Queens and travels to White Plains Train Station where he is picked up by Wimbert in his car on Nov. 27.

Dec 1 Lentini is found on a dark road with a cut on right hand and weapon is recovered nearby. Police break in Wimbert’s apartment to find him lifeless and laying in a pool of his own blood.

Lentini arrested, arraigned, and remanded to Rockland County Jail without bail on the same day. Rumors and speculation about the victim Michael Wimbert, who was once a fish store operator and teaching assistant forin Westchester for two years, have been making the rounds.

The case is expected to go to trial this summer.

Rockland S&M Killer Loses Legal Bid to be Released from Prison

BY JOEL GROSSBARTH

Convicted sadomasochistic murdered Bernard J. LeGeros, lost another bid to be released from State prison after an appeals Court threw out his case this week. LeGeros, who is serving a 25 years to life sentence for the 1985 kidnap and murder of fashion model Eigel Vesti in Stony Point, challenged the denial of the New York State Parole Board to release him from prison after serving 30 years in prison.

In Matter of LeGeros v. New York State Board of Parole, the Appellate Division Court in Brooklyn affirmed an Orange County trial judge’s ruling that dismissed LeGeros’ claims that the Parole Board did not follow the law in denying his 2013 application to be released on parole.

LeGeros claimed that the Board of Parole did not follow the requirements it needed to consider in denying parole. The appeals Court stated that the record demonstrated that the Parole Board considered the appropriate statutory factors in denying the petitioner’s application for release to parole, including his institutional accomplishments, academic and program achievements, prison disciplinary records, post-release residential and employment plans, and letters of support. The Board also considered the seriousness of the petitioner’s crimes. The Board was not required to address each factor in its decision, or to accord all of the factors equal weight

The decision to grant an inmate parole is completely discretionary to the Parole Board. In order to succeed on a challenge to the Parole Board’s decision, an inmate must show that the Board’s decision was irrational to the point of bordering on impropriety. This is a very high burden to show.

LeGeros was scheduled for a hearing last month, but that hearing was adjourned until November. It is likely the hearing was adjourned due to the pending appeal that the Court decided last week.

According to sources in the know, the Eugene Palmer murder and getaway case will be featured on the Sunday, August 21 episode of “John Walsh, The Hunt.”

Walsh was the host of the “America’s Most Wanted” from its first season in 1988 through its final season in 2012. This will be the third season of “John Walsh, The Hunt,” which has aired 16 prior episodes, all during the months of July and August.

On Sept. 24, 2012 Palmer shot and killed his daughter-in-law Tammy Palmer on his property off Willow Grove Road in the Town of Haverstraw. He then fled into Harriman Park and has never been seen or heard in public again.

Tammy Palmer had been estranged from Eugene’s son John, but still living in a small house on Eugene’s property when tempers flared out of control that fateful morning.

Like “America’s Most Wanted,” “The Hunt” focuses on open cases and successful getaways, but instead of delving into several stories over the course of an hour, it focuses on one case for the duration.

DA’S PRESS RELEASE

Rockland County District Attorney Thomas P. Zugibe, together with Angel M. Melendez, Special Agent in Charge of ICE- Homeland Security Investigations in New York, today announced the indictments of Lawrence Lazard (DOB 07/06/87) of 229 Route 202, Apt. 3N, Haverstraw, New York and Fabrice Stinfil (DOB 08/31/95) of 5 George St., Apt.9, Spring Valley, New York for their roles in the theft of approximately $250,000 from multiple banks and their customers by depositing dozens of altered U.S. Postal Service money orders. The defendants are charged in a Rockland County Court indictment with two counts of Grand Larceny in the Third Degree and 25 counts of Criminal Possession of a Forged Instrument in the First Degree (Lazard) and Grand Larceny in the Fourth Degree and Criminal Facilitation in the Fourth Degree (Stinfil).

The charges arise from a joint investigation by the Rockland County District Attorney’s Office’s Special Investigations Unit, the U.S. Department of Homeland Security and the United States Postal Inspection Service.

“These defendants allegedly played a role in a two-state crime spree that resulted in the hundreds of thousands of dollars in fraud,” said District Attorney Zugibe. “With gang members now using old-fashioned deception to cheat banks, law enforcement agencies at all levels are coming together to fight back. The Rockland County District Attorney’s Office will continue to aggressively prosecute con artists and bring them to justice.”

“Lazard is alleged to be a gang member and major player of a group that fraudulently altered money orders and used stolen checks to the tune of over $300,000 dollars” said Angel M. Melendez, special agent in charge of Homeland Security Investigations in New York. “This crime spree has affected 14 different financial institutions in and around Rockland County and shows that street criminals are getting creative on how they steal money. HSI is up to the challenge to uncover these schemes and put those that perpetrate them, in jail where they belong. Stinfil is alleged to have facilitated Lazard to commit part of the overall crime, and to have also stolen money from a bank based upon this fraud.”

BY JOEL GROSSBARTH

The Rockland County podiatrist charged with plotting to kill his wife appeared to answer an indictment handed down by a Rockland County Grand Jury. Ira Bernstein, 42, faced Judge David Zuckerman in Rockland County Criminal Court and pled “not guilty” to each and every county of the indictment.

Bernstein, together with his alleged mistress Kelly Gribeluk, 35, is charged with plotting to kill his wife Susan Bernstein. The indictment issued by the Grand Jury charged Bernstein with three counts of conspiracy and four counts of criminal solicitation. Gribeluk was separately arraigned last month, but Judge Zuckerman indicated that both Defendants would be tried together.

Rockland prosecutor Richard Moran informed the Court he had turned over to the defense counsel several CDs containing over 1700 telephone calls that allegedly support the charges as well as documents and statements made by both Defendants.

Judge Zuckerman entered the not guilty plea on behalf of Bernstein and set a schedule for any pre-trial motions.  Defense lawyer Jeffrey Millman asked the Court for additional time to review the mass volume of evidence turned over by the District Attorney’s office. Bernstein is next due in Court on July 12, 2016 for a preliminary conference.  The trial in this matter will not likely occur until late 2016, or later.

The arraignment was interrupted by a media request to film the proceeding. Over defendant’s objections, Judge Zuckerman allowed filming of the arraignment proceeding only. Any further filming of proceedings will be addressed if a press request is made. If convicted of the top charge of Conspiracy, Bernstein faces a possible prison sentence of anywhere between one to 25 years in prison.
