DA’S PRESS RELEASE

Rockland County District Attorney Thomas P. Zugibe on Monday announced the arrest of Bernard Hughes III, 56 of 4 Trachtenberg Court, West Nyack, New York on one count of Conspiracy in the Fourth Degree, a class “D” felony.

Hughes, a veteran foreman at the Rockland County Highway Department, is accused of trafficking powder and crack cocaine in several local towns and villages during work hours. On numerous occasions over the past 12 months, undercover members of the Rockland County Drug Task Force observed the defendant using a county vehicle to transport and sell several grams of cocaine.

The arrest of Hughes stems from an August 9, 2016 federal indictment charging 11 individuals with trafficking in cocaine and crack cocaine in and around Rockland County. It is alleged that Hughes was a low-level dealer in the drug trafficking organization led by Jemel Goode of Congers, New York.

According to the charges, Hughes conspired with a mid-level drug dealer to transport and sell cocaine in Rockland County. Other amounts of cocaine were purchased by defendant for his own personal use.

Said Zugibe, “In the course of that federal investigation, it was discovered that Hughes was involved with Goode’s cocaine network.”

Hughes was arraigned in the Village of West Haverstraw Justice Court by the Honorable Kevin Russo. He was released on his own recognizance pending a future court date.

He faces up to seven years in state prison if convicted.

taxiClarkstown PD has charged a Manhattan man with second degree assault and second degree kidnapping for allegedly holding a knife to the throat of a 27-year-old female Prestige Taxi cab driver and demanding she take him to New York City for free.
Officers from CPD arrested 30-year-old Joshua Bray of Manhattan on the aforementioned felony charges, as well as a misdemeanor charge of criminal possession of a weapon. They found him shortly after the alleged incident occurred in the area of the Calvary Drive commuter lot in New City, Tuesday evening around 5:30 p.m.
Police said he had fled on foot but was found walking a short distance from Route 304.
The victim, a resident of West Haverstraw, told officers she had picked Bray up on Beechwood Lane in Garnerville with the understanding she would drop him off at the commuter lot so he could take a bus to New York City. When they arrived at the lot he instead pulled a knife and demanded a free ride.

The taxi driver suffered a cut to her thumb when she “instinctively” responded to the attack by attempting to push the assailant away, police said. The resistance may have played a role in Bray deciding to flee the scene instead of continuing his alleged assault.
The victim was treated for a minor laceration at Nyack Hospital. The knife was not found at the scene. Bray was arraigned in Clarkstown Justice Court and bail was set at $75,000. He was transported to Rockland County Jail and will return to court Friday morning.

FROM THE DA’S OFFICE

Mallia MugshotRockland County District Attorney Thomas P. Zugibe today announced the filing of criminal charges against the Town of Ramapo Director of Building, Planning and Zoning for allegedly stealing over $100,000 in a yearlong scheme to falsify building permit applications as the result of an investigation conducted by the Rockland County District Attorney’s Office Special Investigations Unit.

Anthony Mallia (DOB 06/14/64) of 5 Biret Drive, Airmont, New York is charged with:

• One count of Grand Larceny in the Second Degree, a class “C” Felony

• 33 counts of Tampering with Public Records in the First Degree, class “D” Felonies

• 33 counts of Falsifying Business Records in the First Degree, class “E” Felonies

• 33 counts of Offering a False Instrument for Filing, class “E” Felonies

• One count of Official Misconduct, a class “A” Misdemeanor

“This case goes to the very heart of corruption,” said District Attorney Zugibe. “According to the charges, the defendant developed an elaborate scheme to steal taxpayer money rather than to ensure public safety and compliance. His breach of the people’s trust comes at a time when the residents of Ramapo are demanding honesty from their leaders. Such self-serving criminal behavior severely undermines public confidence in government and will not be tolerated.”

Rockland County Executive Ed Day said, “What happens in Ramapo affects all of Rockland. When one official responsible for carrying out the taxpayer’s business applies the rules unfairly, we all suffer. There is one set of rules, one set of laws that everyone is expected to follow.”

District Attorney Zugibe said that, according to the criminal complaint, Mallia was grossly undercharging contractors for building permit applications for new residential construction projects. In the Town of Ramapo building permit fees are determined by “cost of construction.” Throughout 2015, the defendant allegedly approved building permit applications which greatly underestimated the actual cost of construction.

The complaint alleges that Mallia stole more than $100,000 through his scheme, which involved altering and falsely recording the cost of construction for 33 building permit applications, thereby reducing the collection of fees legally owed to the Town of Ramapo. The defendant is accused of filing the phony records with Ramapo’s Building, Planning and Zoning Department.

The defendant is charged with the theft of the fees, in addition to various charges related to the falsification of official town records.

(It should be noted that an indictment is merely an accusation and that the defendants are presumed innocent until proven guilty)

Husband convicted of felony charge in domestic dispute over “disturbing photos”

Clark

A domestic dispute that began with an angry wife confronting her husband over “disturbing photographs” has concluded with the conviction of Nicholas Clark, 33, of Chestnut Ridge on one class “E” felony charge of criminal mischief in the third degree.

The state contended that on January 22, 2014, at approximately 12:40 a.m., Clark intentionally damaged his wife’s laptop computer after she confronted him with “disturbing photographs” she found on his cell phone. According to trial testimony, the defendant reacted violently, making head-to-head contact with his wife and verbally berating her, before smashing and destroying the computer.

According to the charges, Clark fled their condominium at 194 Sierra Vista Lane, Valley Cottage, New York. The victim called 911 to report the incident. The three-day trial ended on September 26, 2016, with the jury finding the defendant guilty of the top count of the indictment.

Clark was ordered to be held in the Rockland County Jail. His sentencing is scheduled for January 3, 2017, when he faces a maximum of three years in state prison. Senior Assistant District Attorney John W. McGowan prosecuted the case.

Authorities described the content of the photos found on the defendant’s phone that came out during the testimony at trial as thus:

“The victim (defendant’s wife) found a photograph that the defendant had taken of the victim’s friend from behind while she was at an ATM machine withdrawing money. The friend did not know she was being photographed and did not consent to the photo being taken. Additionally, the victim found a photograph of the defendant’s father’s girlfriend in a bikini with her head cropped out as well as several celebrity red-carpet wardrobe malfunction photos showing the exposed breasts of female celebrities.

“Further, the victim found that the defendant was following numerous underage girls on Instagram. Just before the attack, the defendant became angered when the victim told him that she found the photograph of her friend at the ATM on the defendant’s phone.”

FOOT DOCTOR’S MISTRESS ADMITS TO MURDER PLOT

It remains to be seen whether she will testify against lover/codefendant Dr. Ira Bernstein in return for leniency

BY JOEL GROSSBARTH

635978720663323715-GribelukIn a surprise move in court, Kelly Gribeluk pleaded guilty to three counts of conspiracy in connection with the plot to kill Susan Bernstein, the estranged wife of her boyfriend Ira Bernstein, a local podiatrist.

Gribeluk, a mother of three children, appeared in court dressed in a black business suit rather than the orange prison jumpsuit that she has worn to her prior Court appearances. In her plea, Gribeluk answered questions from Judge David Zuckerman and admitted that she was, in fact, guilty of the charges against her.

Upon accepting her guilty plea, Judge Zuckerman ordered that her bail be reduced from $600,000 to $50,000 with the condition that she wears a GPS monitoring bracelet on her ankle until her sentencing on January 3, 2017.

Gribeluk’s plea raises serious questions as to the defense that Ira Bernstein continues to raise. By definition, a conspiracy requires two or more people to agree to commit a crime together with an overt act in furtherance of the agreement.

Although Bernstein and Gribeluk were indicted under the same indictment, the court has treated the two defendants separately. It is unclear whether Gribeluk would testify against Bernstein if his case goes to trial. Assistant District Attorney Richard Kennison Moran made no representations as to whether Gribeluk was offered any type of promise by the prosecution at her sentence.

Bernstein is scheduled to appear in Court on October 4, 2016 to determine if the case is ready for trial. Bernstein continues to assert his “not guilty” plea in connection with the same charges that Gribeluk has now pled guilty to.

Gribulek is the former Kelly Myzner, a one time ultra-Orthodox wife and mother whose custody case made headlines due to accusations that Judge Sherri Eisenpress had a religious bias in favor of her husband.
