Driving While Intoxicated

On Friday February 23, 2019 at approximately 10:30 PM, the Clarkstown Police Department responded to an erratic driver on Germonds Rd in New City. The responding officer observed the reported vehicle and conducted a car stop on Rt. 304. The driver, Hung Huynh, 51, of Jersey City, NJ, was interviewed and appeared to be intoxicated. Huynh was given field sobriety tests, which he failed. He was placed under arrest and transported to Clarkstown Police Headquarters. He was charged with DWI (felony) due to a prior conviction within 10 years, aggravated unlicensed operator 1st (felony) and use of a rental car without interlock device (misdemeanor). Huynh was court mandated to operate a motor vehicle with an interlock device stemming from his previous DWI conviction. He was arraigned in Clarkstown Justice Court. Bail was set at $5,000. Huynh was transported to Rockland County Jail and will return to court on February 25, 2019 at 1:30 PM.


Weapons Charges & Endangering the Welfare of a Child

The morning of February 25 at approximately 6:30 am, the Ramapo Police Department assisted the ATF with a search warrant of a residence in the Village of Airmont. As a result of the search, a firearm and an amount of heroin were located inside the household. A 41-year-old female was arrested for various weapon charges and a 21 year old female and 24-year-old male were charged with drug possession. A juvenile was also present in the household and all 3 parties were charged with Endangering the Welfare of a Child. A referral to Child Protective Services was also initiated.

Conducted Transactions in Residential Neighborhoods; Thousands of Dollars, Over Three Pounds of Narcotics Recovered 

Acting Rockland County District Attorney Kevin Gilleece, joined by Town of Haverstraw Police Chief Peter Murphy and Rockland County Executive Ed Day, today announced that eleven individuals have been variously charged in separate indictments with criminal sale of a controlled substance, conspiracy and other crimes for their alleged roles in a large-scale heroin trafficking operation based in the Town of Haverstraw.

District Attorney Gilleece said, “The indictments describe a tightly-knit narcotics ring operating from private homes in Haverstraw and West Haverstraw that catered almost exclusively to drug buyers in Rockland County. The criminals who push this deadly poison in our neighborhoods – motivated only by profit – devastate our community and feed the disease of addiction, which has touched all of us. My office will continue to aggressively track down those who make it their business to traffic in drugs in Rockland County.”

“I applaud the efforts of the District Attorney’s Office, the Town of Haverstraw Police Department and the County Drug Task Force in getting these dangerous drugs off the streets of our communities. Their efforts are a critical part of the comprehensive approach we are taking here in Rockland to combat this epidemic. We will continue to approach this problem from every angle and will not allow those who caused it to escape justice,” said County Executive Day.

The investigation dubbed “Operation True Lady” began in June 2018 when detectives assigned to the Rockland County Drug Task Force received information regarding a sweeping heroin network allegedly led by Santos Alvarado (DOB 07/18/76) of 91 Blauvelt Avenue, West Haverstraw, New York.

Detectives quickly developed information that led to Alvarado’s customers, source of supply and methods of distribution. It was soon determined that the defendant was using his home as a base of operations, from which he allegedly sold heroin to customers.

Two of Alvarado’s suppliers were identified as Ramon Dejesus (DOB 11/10/64) of 52 Westside Avenue, Unit #2, Haverstraw, New York and Ernest Camacho (DOB 08/05/77) of 203 Route 9W, Haverstraw, New York. Both Dejesus and Camacho also allegedly utilized their Haverstraw homes as their respective bases of operations.

Dejesus’ and Camacho’s source of supply was identified as Elio Duarte (DOB 01/05/59) of 7 Wargo Court, West Haverstraw, New York. It was determined that Duarte utilized both public transit and private transportation to travel to the homes of Dejesus and Camacho to re-supply the two with heroin.

On December 14, 2018, Duarte was arrested in a vehicle stop in Haverstraw, along with his wife Jeanette Toribio (DOB 11/14/63) of the Dominican Republic and daughter Yanery Martinez (DOB 9/12/83) of 486 East 29th Street, Paterson, New Jersey. All three were occupants in Martinez’ Toyota Highlander, in which the Rockland County Drug Task Force and Haverstraw Police recovered over three pounds of heroin.

Detectives also recovered an additional 2 1/2 kilograms of heroin, $23,210 in cash and other drug paraphernalia. The ring allegedly sold several “brands” of heroin, including “True Religion,” “Sexy Lady,” and “Pitbull.”

Besides ringleader Alvarado, other customers of Dejesus and Camacho who re-sold heroin were identified as Pedro Lopez, Alan Jones, Jerry Ramirez, Brian Moore and Jose Candelario. [See addendum for the full list of defendants and related charges.] 

The defendants – who range in age from 23 to 60 – are variously charged with first, second- and third-degree criminal sale of a controlled substance, first, second and third-degree criminal possession of a controlled substance, fourth-degree conspiracy and related counts. The top count in the indictment carries a maximum sentence of up to 20 years in state prison.

The investigation was conducted by the Haverstraw Police Department, the FBI and the Rockland County Drug Task Force.

The case is being prosecuted by Senior Assistant District Attorney Michael Dugandzic.

Arrest reports from Stony Point Police Dept. 

MARCH 2, 2019:

Arrest: Female; Prentice, Kristen; Age 35, of West Main Street, Stony Point, NY Charges: Criminal Mischief

On March 2, 2019 at approximately 11 a.m., while on routine patrol, an officer was stopped by a passing motorist who saw a female knocking out the windows of a van in front of a home on West Main Street in Stony Point. Upon arriving at the home, the officer observed the defendant in front of the home with her hand bleeding. Investigation found that the defendant, during a domestic argument, broke the windows of her boyfriend’s van using a power tool as a weapon.. The Defendant was placed under arrest and charged with Criminal Mischief. She was arraigned and released on $250 bail with an appearance ticket to return to Stony Point Justice Court on March 19, 2019.

 

MARCH 3, 2019:

Arrest: Male; Hewitt, Anthony; Age 50, of Bayview Drive, Stony Point, NY Charge: AggravatedDWI

On March 3, 2019 at 9:45 p.m., an officer responded to a call of a one vehicle accident into a guardrail on Reservoir Road in Stony Point. During the investigation, the Defendant admitted to consuming alcohol and had slurred speech and was unsteady on his feet. The defendant blew a Breathalyzer over the legal limit over .08 BAC and over .018 which raises the charge to Aggravated DWI. The Defendant was arrested, processed and released with an appearance ticket to appear in Stony Point Justice Court on March 21, 2019 at 1:30 p.m.

MARCH 3, 2019:

Arrest: Male; Gulifield, Anthony; Age 52, Dickinson Avenue, Nyack, NY Charges: Criminal Contempt 1st

On March 3, 2019, an officer responded to a residence on Thiells Road around 2 p.m. on a report of a domestic disturbance. Upon arrival, the Officer spoke with a female victim who advised that the Defendant was in her residence and refused to leave. A file check showed that a full stay away Order of Protection was in effect. The Defendant was placed under arrest for Criminal Contempt-1st. He was processed, arraigned and remanded to Rockland County Jail. He is scheduled to appear in Stony Point Justice Court on March 7, 2019, at 1:30 p.m.

Identity Theft Arrest in Nanuet

On March 8, 2019 at approximately 4:30 p.m. the Clarkstown Police Department responded to a report of possible fraud at The Sprint Store, located at 40 Rockland Plaza in Nanuet, NY. Patrol officers responded and interviewed the 29-year-old male employee who told officers that a female suspect was attempting to access a Sprint cellphone account to purchase 2 iphones for a total of $2,199.

Officers were able to verify that the primary account holder of the cell phone had no idea who the suspect was and had never given permission for her to be on the account. It is still unknown how the suspect was able to get on the account. The investigation will continue on this matter. The suspect, Sara Francisca Amaro, 24, of Astoria, NY, was arrested and transported to police headquarters for processing.

She was charged with identity theft 1st (felony), identity theft 2nd (felony) and attempted grand larceny 4th (felony). She was arraigned in Clarkstown Justice Court. Bail was set at $5,000 and transported to the Rockland County Jail. Amaro is due to return to court on March 11, 2019 at 1:30 p.m.

Arrest of Suspect: Child Struck By Car in Nov. 2017

The Clarkstown Detective Bureau last week confirmed that Carlos Osvaldo Garcia-Gonzalez has been taken into custody in Indiana by the U.S. Marshals Service in regards to an indictment that had been issued for the charges stemming from the hit and run accident that occurred in Congers, NY on November 21, 2017.

The culmination of an intensive investigation into the hit and run of a 7 year old girl on her way to school has led to the identification and arrest Carlos Osvaldo Garcia-Gonzalez, 27, of Brazil, Indiana. He is currently being detained in the Clay County Justice Center awaiting extradition. Based on information developed by the Clarkstown Detective Bureau, the possible location of the suspect was developed and that information was passed to the Marshals for their assistance in his apprehension.

“The Clarkstown Police Department applauds the outstanding work of the U.S. Marshals Service for their never ending pursuit of this suspect. You can’t come into this community, hit a seven year old girl on her way to school, drive away and think we will not do everything in our power to apprehend you. Today’s arrest shows the commitment of the law enforcement community throughout the Nation” said Clarkstown Police Chief Raymond McCullagh.

BOCES student allegedly stabs classmate with scissors

A student at Rockland BOCES allegedly stabbed a classmate with scissor Tuesday morning, according to Clarkstown PD.

Police said that at approximately 8 a.m. Tuesday morning officers responded to a call of a reported assault at Rockland BOCES, 65 Parrott Rd. in West Nyack. The investigation determined that the 16-year-old male victim and the 17-year-old male suspect had an argument after exiting the school bus.

The suspect allegedly proceeded removed a pair of scissors from his pocket and stabbed the victim once in the right shoulder area. The injury was non-life threatening and the victim was transported by ambulance to Nyack Hospital for medical treatment.

The School Resource Officer assigned to BOCES interviewed the victim and suspect, who were still both on scene. The 17-year-old suspect was taken into custody and transported to police headquarters for processing. The suspect’s identity will not be released due to his age and potential juvenile offender status that will be determined by a judge. He was charged with second degree assault (felony), second degree menacing (felony) and fourth degree criminal possession of a weapon.

The Clarkstown Police Department has been working with Rockland BOCES school administrators to ensure notifications were made to the parents of all involved. The initial investigation indicates that the incident was confined to the two students and the safety of other children and staff was not jeopardized. 

The suspect will be arraigned in Clarkstown Justice Court at a later time.

Clarkstown PD Community Policing Initiative Focused on Fighting Scams

The Town of Clarkstown is just like the rest of the country when it comes to its residents falling victim to scams and fraudulent activity.

More often than not, the victims of these scams are the elderly. Local police are trying to combat this ever increasing crime spree,where victims have lost tens of thousands of dollars.

On Wednesday morning, the Clarkstown Community Policing Unit went to stores in the town that sell gift cards and Green Dot Money Pak cards. Stores like CVS, Walgreens, 7-Eleven and Rite-Aid are stores that have been used by victims to purchase the gift cards needed to pay off scams.

Community officers Kennedy and Valerio went to these stores to request that store employees be vigilant when someone attempts to buy thousands of dollars’ worth of gift cards. Clarkstown officers also posted reminders to potential victims that if they are buying these cards because of a potential scam to please call 911.

CPD asks store employees to be the eyes and ears of the police to prevent some of these scams. 

 


Massachusetts man arrested for drug possession following a traffic stop on the Thruway

On March 20, 2019, at approximately 1:20 a.m., State Police stopped a vehicle on I-87 in the town of Clarkstown for a vehicle and traffic violation. While interviewing the driver, probable cause to search the vehicle was established. The driver, Joaopedro Deoliveirasantos, 21, of Revere, MA, was found to be in possession of approximately 7.9 grams of concentrated marijuana and 14 grams of hallucinogenic mushrooms. He was arrested, transported, and processed at SP Tarrytown where he was charged with the following:

  • Criminal Possession of a Controlled Substance fourth degree (hallucinogenic substance); a Class C felony
  • Criminal Possession of a Controlled Substance seventh degree; a Class A misdemeanor
  • Vehicle and Traffic violations  

Deoliveirasantos was arraigned before the Town of Clarkstown Court and remanded to Rockland County Jail in lieu of $5,000 cash or bond. A return court date of March 25, 2019 has been set.

CRIMINAL TRESPASS & DISORDERLY CONDUCT
Anthony Lleras, age 26, of Maple Avenue, Haverstraw, NY, was arrested on March 25, 2019. Officers responded to a 911 call of a fight at a restaurant on 9W in Stony Point. The defendant was at the business to speak to his girlfriend, an employee, and was asked several times to leave, as she did not want to speak to him. He refused to leave and attempted to enter an Employee-only area of the business and had to be forcibly stopped by employees. Responding officers placed Anthony Lleras under arrest. Defendant was released with an appearance ticket with a court date of April 18, 2019, at Stony Point Justice Court.

 

 

ASSAULT
Robert Millett, age 30, of Hoover Place, Stony Point, NY, was arrested for assault in the third degree and endangering the welfare of a child. On March 25, 2019, the defendant turned himself in at Stony Point Police Department for the above charges stemming from a domestic dispute that occurred on March 23, 2019 at a Stony Point home. The defendant is accused of assaulting his live in girlfriend in front of her child. The defendant was arraigned in Stony Point Justice Court and released after posting $250 bail with a return date of May 7, 209 at 9:00 a.m. Orders of Protection were issued in court.

Charges: DWI Breath Test Violation
On April 12, 2019, Officer responded to complaints of a vehicle driving erratically at Shoprite on Holt Drive in Stony Point. The Officer located the reported vehicle traveling West on Holt Drive. Upon further investigation, the Operator of the vehicle was found to be in an intoxicated state and was placed under arrest for DWI and a Breath Test Violation (refusing a test). The Defendant was processed at Stony Point Police Department and released on recognizance, with a return date to Stony Point Justice Court on May 21, 2019 at 1:30 p.m.

On April 15, 2019, Officers responded to Park Road in Stony Point for a possible disabled vehicle and possible dispute. Upon arrival, two individuals were found at the scene, and the Defendant admitted to driving the vehicle to the scene. The Defendant showed signs of being in an intoxicated state, and also was found to be in violation of an active Stay Away Order of Protection, being that his female passenger was the protected person on the OOP. Defendant had a BAC over 3 times the legal limit of .08. The Defendant was arrested for the above referenced charges and processed at Stony Point Police Department. He was arraigned on the Criminal Contempt -2nd charge and was released with an appearance ticket returnable to Stony Point Justice Court on April 16, 2019 at 1:30 p.m.

Double-stabbing on Main St. in Haverstraw

Two women were stabbed outside 83 Main. St in downtown Haverstraw village this afternoon. They were rushed to the hospital and their severity of their condition has not been reported by police at this time.

A witness told the Rockland County Times that he saw one female laying down with a stab wound to her neck and a second victim, also visibly bleeding, standing near the female who was on the ground. Police did not confirm whether the assailant of the two girls was a male or female but witnesses said they believe it was a female.

Lt. Marty Lund of Haverstraw PD said the department would be releasing a statement later this evening or tomorrow morning regarding the crime and the medical condition of the victims.

Today’s double stabbing follows an attempted murder last week in Rt. 9W commercial district of West Haverstraw, in which a male stabbed his estranged girlfriend.

Angelica Bare, 24, of Haverstraw turned herself into police this afternoon, charged with two counts of first degree assault for allegedly stabbing two women near the intersection of Liberty St. and Main St. in the Village of Haverstraw Tuesday afternoon.

Police said that at approximately 4:58 p.m. the Haverstraw Police Department responded to Liberty and Main St. for a report of an assault in progress. Officers found two females lying on the sidewalk suffering from stab wounds. First aid was administered to the victims by first responding Officers until Emergency Medical Service personnel.

Bare fled on foot following the incident and police were unable to locate her Tuesday evening.

She turned herself in to police custody this afternoon at 3:50 p.m., accompanied by her attorney. Bare will be arraigned Wednesday evening at the Village of Haverstraw Justice Court.

An anonymous witness familiar with the suspect and victims told News12 Bare was angry about a situation involving a man.

This is not Bare’s first brush with the criminal justice system. She faced felony charges in 2017 for possession of 2 lbs. of marijuana – street value estimated $6,000.

Trial begins for Nyack chiropractor accused of sexually violating teenage client

SOUTH NYACK – Testimony has begun in the sex abuse trial of Kristina Wodicka, a South Nyack chiropractor accused of inappropriate touching of a 14-year-old client over the course of four months in 2015.

The case is being heard by Acting Justice Thomas Mascola in Village of South Nyack Court. Village Justice Dennis Lynch recused himself from the case.

The alleged misconduct Wodicka stands accused of includes putting her hands underneath the minor’s shirt, touching her breasts and inserting fingers into her vagina. According to papers filed in court, Wodicka met with a detective and, after being informed of her Miranda warnings, voluntarily stated that she diagnosed the minor with a hiatal hernia and placed her hands on pressure points on her upper chest, below her breasts, stomach and around her hips.

The detective’s reports indicate that Wodicka admitted that she might have crossed “some boundaries” while treating the minor patient.

The minor told the detective that at one point Wodicka said,  “Don’t tell [your] mom, she wouldn’t understand the treatment we are doing.” The detective also said Wodicka told the minor that she had memories of past lives haunting her and Wodicka had to scare them off. After allegedly touching the victim inappropriately, Wodicka told the minor, “They are gone.”

Wodicka was arrested in 2016 and charged with first degree sex abuse, a class D felony. Later the charges were reduced to misdemeanors.

If convicted, she will be forced to register as a sex offender and spend up to one year in jail.

There have been a string of delays in the case, most relating to the health of Wodicka’s former attorney. Though the case has been ongoing for two years, the Rockland County Times is the only news outlet to have reported on this story.

 

 

Nyack Chiropractor Cleared of Abuse Charges

Kristina Wodicka has been found not guilty of the abuse charges leveled against her by a former patient.

During a lengthy trial last month the doctor faced eight counts of sexual abuse in the third degree and one count each of forceful touching and endangering a child. Her alleged victim was a teenage girl who originally sought treatment from the chiropractor and N.E.T. therapist for “body image issues.”

Wodicka was arrested in the summer of 2016 after one of her former patients, whose name has been withheld, came forward with allegations of sexual abuse that supposedly occurred while she was being treated in the fall of 2014. The accuser had claimed that the abuse continued and escalated over a 6-month period, culminating in her attempted suicide after her final visit to the office in February 2015.

Mahmoud Rabah, Wodicka’s attorney, focused his defense on the mental state of the accuser, who was being treated for a number of mental health problems at time of her visits. Rabah was able to establish that the patient, according to her mother’s testimony, was intermittently taking Klonopin, a sedative with a range of potential side effects that include drowsiness and suicidal tendencies, during the months she was being treated by Wodicka. Rabah argued that many if not all of the symptoms of the alleged abuse were side effects of the teenager’s inconsistent use of the drug; he was also quick to point out major inconstancies between the mother’s testimony and her daughters. While her mother described the alleged victim as suffering night terrors, incontinence, and insomnia, the girl denied exhibiting any such behavior.

Prosecutor Stephanie Schera portrayed Wodicka as a calculating manipulator who gradually “groomed” the girl for abuse. When Wodicka admitted to performing a haiedel hernia exam on her patient, Schera repeatedly reminded the jury that the patient had not initially come to Wodicka’s office with complaints of any physical aliment. She portrayed the exam as an excuse for touching the patient and a stepping stone to further abuse.

The prosecutions also seized on the fact that Wodicka had given her patient CBD oil, a product that contains THC and is not intended for use by minors.

Schera argued that the doctor was deliberately trying to disorient her patient and that the girls deteriorating mental condition could be linked to the substance. Expert medical witness called by the defense established that CBD oil is non psychoactive and could not significantly alter a person’s behavior.

Both parties focused on the location of the supposed abuse as a key piece of their argument. Several witness for the defense stated that it would have been extremely difficult for the descried abuse to go unnoticed in their office. Both of Wodicka’s medical assistants, and her ex-husband Dr. Kenneth Zat’s, testified that it was common-place for medical assistants to walk into the exam rooms while the doctor was seeing a patient. Dr. Zat’s, who shared the office with Wodicka also testified “that the walls were paper thin” and that he nor any of the other staff ever heard anything that would lead them to believe physical abuse was occurring in the office.

The prosecution flipped this logic on its head by arguing that a noisy office would be beneficial to a potential abuser as it would be difficult to hear anything going on. Detective James Coyle, the officer in charge of the investigation, admitted during testimony that he did not perform a thorough investigation of the office, deeming it “unnecessary.”

RAMAPO YOUTH GYMNASTICS COACH PLEADS GUILTY TO SEXUALLY ABUSING YOUNG STUDENTS

Acting Rockland County District Attorney Kevin Gilleece today announced that Joseph Lewin (DOB 05/16/51) of 27 Mitchell Place, Port Chester, New York, has admitted to all of the allegations in the indictment and ultimately pled guilty to:

 Course of Sexual Conduct against a Child in the Second Degree, a class “D” Violent Felony

District Attorney Gilleece said, “As a youth coach, this defendant held a position of power over his students. He abused their trust and took advantage of his vulnerable victims. He has pled guilty, waived his right to appeal and will now be held accountable for the terrible crimes he committed. Such predatory conduct cannot go unpunished. He will go to State Prison where he belongs.”

Lewin, a longtime gymnastics coach who owned and operated “Joe’s Gym” in Hillburn, admitted to engaging in sexual contact with the young victims between 2007 and 2014.

Sentencing has been scheduled for September 9, 2019 before the Honorable David S. Zuckerman. Lewin faces four years in state prison and five years post-release supervision. Upon his release, he must register as a sex offender under the provisions of Megan’s Law.

Supervising Assistant District Attorney Jennifer Parietti of the Rockland County District Attorney’s Office Special Victims Unit prosecuted the case.

Reckless Endangerment Arrest in Clarkstown

On July 10, 2019 at approximately 9 p.m. a Clarkstown Patrol Officer observed a vehicle parked in the underground parking garage of the Palisades Center Mall that matched the description of a vehicle that had fled the scene of a Clarkstown Patrol Officer’s traffic stop days before.

The vehicle, a 2014 black Mustang Shelby, matched the description and the partial license plate information from the July 8, 2019 incident when the vehicle fled the scene. Three males entered the vehicle and drove off from the parking garage. As the officer began to follow the vehicle onto the NYS Thruway, it sped away at speeds believed to be in excess of 130 MPH, weaving in and out of traffic and driving on the shoulder of the road. Due to the dangerous speeds and the extreme reckless behavior of the speeding Mustang, the officer decided not to pursue the Mustang.

Based on the vehicle and license plate information gathered by the patrol officer, the vehicle was located in a parking lot on W. 239th Street Bronx, NY. The vehicle’s operator was also located and was identified as Steven Simkin, 23, of Bronx, NY. The Mustang Shelby was impounded and towed back to Clarkstown Police Headquarters.

Simkin appeared at police headquarters on July 11, 2019 and was charged with reckless endangerment in the first degree (felony), unlawful fleeing a police officer in the third degree (misdemeanor) and nine various traffic infractions. He was arraigned in Clarkstown Justice Court. Bail was set at $5,000 and he was transported to the Rockland County Jail. Simkin will return to court later in the month.

Steven Simkin is a frequent participant in a group of car enthusiasts who meet in the Nanuet area. We have received many reports of speed racing in that area and have taken an aggressive approach to apprehend offenders. The department will confer with the Rockland County District Attorney’s Office to possibly seize the vehicle from the offender.  

CLARKSTOWN PD: Car Larceny Arrest

Last week the Clarkstown Police Department arrested a 21-year-old male from Spring Valley for breaking into vehicles parked in driveways, stealing valuables from those vehicles. The suspect appeared to have been walking through the neighborhood checking for unlocked car doors. He was able to remove change and a small amount of cash from these cars.

The incident occurred on July 18, 2019 at approximately 5 a.m. A homeowner residing on S. Pascack Rd in Nanuet was awoken by a notification from their home surveillance system that there was motion detected in their driveway. A description of two males entering their vehicle was observed on video. The responding officers established a perimeter of the area after two males were seen by officers.

An extensive search was conducted and through additional information being called in by other neighbors, one suspect was taken into custody. The second male has not been located but the investigation continues. The male was charged with petit larceny (misdemeanor), criminal possession of stolen property in the fifth degree (misdemeanor) and resisting arrest (misdemeanor).

He was arraigned in Clarkstown Justice Court. He was released on his own recognizance and will return to court on July 29 at 9:30 a.m.

This arrest highlights the problem of car larcenies as a crime of opportunity. The Clarkstown Police Department reminds homeowners to take the extra minute to remove valuables from your vehicles, remove keys or fobs from you vehicle and lock your doors.

NEW CITY FATHER CHARGED IN OVERHEATING DEATH OF 1-YEAR-OLD TWINS

Juan Rodriguez of New City is accused in the death of his one – year old twins Luna and Phoenix after leaving them in his car on Friday. He plead not guilty in Bronx Criminal Court.

Rodriguez claimed he thought he dropped off the infants at their day care after he had dropped off his four – year old at day care. When he discovered his babies in the backseat of his car hours later, police say Rodriguez said, “I blanked out. My babies are dead. I killed my babies.” Police say they had body temperatures reaching 108 degrees when they died.

Rodriguez was charged with manslaughter and criminally negligent homicide in the deaths of his 1-year-old children. His out on bail which was set at $100,000. “He does not need to serve any jail time and be punished further than what he’s already going to be suffering,” said neighbor Tony Caterino to News 12.

“I want to express my gratitude to the Parole Officers in Erie County for keeping a close watch on Richard LaBarbera and doing what the New York State Parole Board failed to do; keeping this child killer in jail. Not surprisingly, it only took him days to run afoul of the law. I remind all that this cretin was on parole when he murdered Paula so he clearly has learned nothing other than how to be a scar on society. I ask the Governor to revisit all the recent decisions of the Parole Board as this type of behavior is exactly what I was speaking of when calling for LaBarbera to remain behind bars. This monster does not deserve to walk free on our streets while our community still suffers from the loss and pain he caused. He committed murder, a crime of permanency, and should be permanently in jail.”
