NARRATIVE: On May 2, 2013 the Stony Point Police Department arrested the above individual on the above listed charges. The arrest was the result of a warrant investigation. It is alleged that the defendant did impersonate another and steal $990 from a bank account whereas it is further alleged that he forged and was in possession of the victims check. The defendant committed said acts without the owner’s permission or consent. The defendant was arrested, processed and remanded to jail, pending a future court date.

Harriman State Park, N.Y. –  A 73-year-old man who police believe escaped into a vast New York forest after allegedly gunning down his daughter-in-law seven months ago and was widely believed to be dead, may be alive and on the run, authorities tell FoxNews.com.

Eugene Palmer, of Stony Point, N.Y., is wanted in the Sept. 24 shooting death of his daughter-in-law, Tammy Palmer, in what authorities described as a “cold-blooded” and “premeditated” murder.

“I don’t believe he’s in that park. He’s been out of that park since September.”

Palmer waited for his 39-year-old daughter-in-law to place her to two children on a school bus before shooting her three times with a bolt action shotgun as she walked up the driveway toward her home, police said. Palmer, a retired part-time park ranger, then fled into Harriman State Park — a 46,000-acre stretch of woodland filled with caves, root cellars and abandoned mine shafts that borders the man’s home, according to police.

Jefferson Cabrera, age 26, residing at 61 Broadway, Haverstraw, NY, was sentenced April 30, 2013, before Rockland County Court Judge William K. Nelson to a state prison term of 2 ½ years and 10 years post release supervision after pleading guilty to sexual abuse in the first degree. District Attorney, Thomas P. Zugibe stated that on or about early April, 2012, and on or about April 30, 2012, the defendant fondled the penis of a six year old boy who was known to him at his residence.

ATTEMPTED ASSAULT
Eric Davis, age 27, residing at 48 Clinton Street, Spring Valley, NY, was sentenced May 1, 2013, before New York State Supreme Court Justice William A. Kelly to a state prison term of 5 ½ years and 3 years post release supervision after pleading guilty to attempted assault in the first degree. District Attorney Thomas P. Zugibe stated that on or about May 11, 2012 at approximately 10:50 a.m., the defendant approached the victim from behind while the victim was on the porch of 83 Fred Hecht Drive, Spring Valley speaking with other individuals. The defendant stabbed the victim multiple times in the back and chest with a knife. The victim was rushed to the nearest local hospital where he was treated for multiple stab wounds.

AGGRAVATED UNLICENSED OPERATION
Terrance Wright, age 32, residing in Bronx, NY, pled guilty on March 6, 2013 to aggravated unlicensed operation of a motor vehicle in the first degree. District Attorney, Thomas P. Zugibe stated that on or about December 14, 2012 at approximately 12:40 p.m. on West Route 59 in the Village of Spring Valley, the defendant operated a motor vehicle while his driving privileges in the State of New York were suspended and revoked. The defendant has 53 total suspensions on 31 separate dates. On April 17, 2013, the defendant was sentenced by the Honorable Charles Apotheker, County Court Judge, to one year in the Rockland County Jail.

AGGRAVATED UNLICENSED OPERATION
Christina Atzl, age 24, residing in Bardonia, NY, pled guilty on August 29, 2012 to aggravated unlicensed operation of a motor vehicle in the first degree. District Attorney, Thomas P. Zugibe stated that on or about June 28, 2012 at approximately 2:01 a.m. on Route 303 in the Town of Clarktown, the defendant operated a motor vehicle upon a public highway while under the influence of alcohol while her driving privileges in the State of New York were suspended. On April 24, 2013, the defendant was sentenced by the Honorable Charles Apotheker, County Court Judge to one year in the Rockland County Jail; she needs to install an ignition interlock device on any car that she may own or operate for one year after release from jail, a $500 fine and $395 mandatory court surcharges.

DRIVING WHILE INTOXICATED
Luis B. Rosario, age 60, residing at 31 Prospect Street, Garnerville, NY, pled guilty on April 17, 2013 to driving while intoxicated as a felony. District Attorney, Thomas P. Zugibe stated that on or about February 22, 2013 at approximately 7:76 p.m. on Main Street in the Village of Haverstraw, the defendant was found to have been operating a motor vehicle while intoxicated. The defendant had a previous DWI conviction in 2006 in the Village of West Haverstraw. Sentencing is scheduled for June 26, 2013 before the Honorable Charles Apotheker, County Court Judge.

UntitledRockland County District Attorney Thomas P. Zugibe Wednesday announced that Barbara Cummaro, 59, of 2765 Denby Drive, Yorktown Heights, New York has been charged with one count of grand larceny in the second degree, a class “C” felony. Cummaro, who was employed as the head of operations by a Rockland County abstract company, is alleged to have stolen over $199,000 from several escrow accounts related to the business.

According to the charges, the defendant used her access to the accounts to write checks to herself. Between January, 2012 and April, 2013, Cummaro allegedly drained at least four escrow accounts by writing 28 checks. The checks ranged in amounts from $12,000 to $24,950. The defendant is accused of creating paperwork to cover-up the alleged theft.

The total amount stolen from her employer was $199,039.68. Upon learning of the theft, the firm immediately replaced all of the funds in the escrow accounts.

The arrest of the defendant resulted from an investigation conducted by the Rockland County District Attorney’s Office Special Investigations Unit.

The defendant was arraigned in the Clarkstown Justice Court on before the Honorable Craig Johns and released on her own recognizance.

If convicted, the defendant faces a possible state prison sentence of up to 15 years.

AUO & OPERATING WITH SUSPENDED REGITRATION
Jennifer Mulholland, age 30, residing at 158 N. Liberty Dr., Apt. B., Stony Point, NY, was arrested on May 10, 2013 for aggravated unlicensed operation in the second degree and operating with a suspended registration. The defendant was arrested after a patrol vehicle equipped with an LPR revealed the vehicle she was operating had a suspended registration for an insurance lapse. Further DMV inquiry verified said registration was suspended and that the defendant was also driving with a suspended NYS driver’s license for fail to answer summons x 10. In addition to stated charges the defendant did have an active Arrest Warrant out of the Town of Haverstraw for A Suspended Registration. The defendant was arrested, processed and issued numerous traffic summonses returnable June 20, 2013 at 1:30 pm after posting $100 cash bail. The defendant was then turned over to the Town of Haverstraw Police Department on the arrest warrant.

PETIT LARCENY & CRIMINAL POSSESSION OF STOLEN PROPERTY

The defendant was arrested after an  investigation into a shoplifting complaint at the Shop Rite of Stony Point determined she did remove numerous items from said location without paying for same. The defendant was arrested, processed and released on an appearance ticket returnable June 6, 2013 at 1:30 p.m.

ISSUING A BAD CHECK
mullingsNatalie Mullings, age 37, residing at 94 N. Main St., Spring Valley NY, was arrested on May 6, 2013 for issuing a bad check. The defendant was arrested after a warrant investigation in which it is alleged the defendant did issue a check for payment while knowing her account did not have sufficient funds to cover same. The defendant was arrested, processed and released on an appearance ticket returnable June 6, 2013 at 9 a.m.

Watson Germosen, age 22 residing at 34 Wall Street, Garnerville, NY, was sentenced May 8, 2013, before New York State Supreme Court Justice William A. Kelly, to a state prison term of five and half years and five years post release supervision after pleading guilty to assault in the first degree. District Attorney Thomas P. Zugibe stated that on or about May 5, 2012 at approximately 9:30 p.m. the defendant stabbed the victim in the face while at 16 South Route 9W in the Village of Haverstraw. The defendant caused the victim to suffer serious physical injury as well as disfigurement of his face.

CLARKSTOWN DWI

CLARKSTOWN PD

On Monday, May 13, 2013 shortly after midnight, Anthony Passarella, 32, from West Nyack, NY was arrested for DWI.

Passarella was driving a 2001 Honda east on Laurel Road in New City when he failed to stop at the intersection with Brewery Road and struck a guardrail headon. Passarella appeared to be intoxicated and had the smell of an alcoholic beverage on his breath. He was trapped inside of the vehicle and required to be extricated by New City FD.

Upon extrication, Passarella was transported to Nyack Hospital for his injuries which did not appear to be life threatening. He was arrested and submitted to a blood test to determine his blood alcohol concentration. Results are pending.

Passarella was issued an appearance ticket returnable to Clarkstown Justice Court on May 20, 2013 to answer the charge of driving while intoxicated (misdemeanor).

New Yorkers for Life Reacts to Gosnell Verdict

Earlier this week, a Pennsylvania jury found Philadelphia-abortionist Kermit Gosnell guilty on three out of four first-degree murder charges in the deaths of children born alive in his facility. Gosnell has also been found guilty of the involuntary manslaughter of a woman who lost her life after being excessively medicated. Gosnell faces either life in prison or the death penalty for his crimes. Kirsten Smith, spokeswoman for New Yorkers for Life, made the following comments:

“Women and men across America can take some small comfort in the knowledge that Kermit Gosnell will be punished for his callous, negligent treatment of female patients and for committing infanticide against infants born alive following late-term abortions. The sad truth, however, is that the mistreatment of women and infants by late-term abortionists is not confined to Gosnell’s horrific abortion mill. Recent reports make it abundantly clear that late-term abortionists display callous disregard for the lives and well-being of female patients as well as infants born alive following late-term abortions. New Yorkers should not rest easy until Governor Andrew Cuomo’s late-term abortion expansion proposal – which would, in essence, roll out the red carpet for late-term abortionists like Gosnell – has been defeated.”

Brandyn Brady, 20, of Tomkins Cove, a popular local musician in the band Truth Be Told, was arrested Monday, charged with possession of 2.1 grams of heroin (enough for several persons to overdose on) and a small quantity of marihuana. Note: heroin is even deadlier when combined with other drugs or alcohol.

At Tuesday’s town board meeting Stony Point Police Chief Brian Moore made light of the continuing and still growing problem in Stony Point and throughout Rockland County: the abuse of opioids, especially heroin, by young people, often leading to overdose and death. These deaths are not always reported in the media, Chief Moore noted, as patients are sometimes checked in to the hospital for other reasons, such as dehydration.

Moore said these days heroin problems often take root when young persons raid their parents’ or grandparents’ medicine cabinet for prescription pills. They figure, since the pills are legal, they are safe.

However, prescription meds like Oxycodone or Oxycontin contain the same chemical opioids from the poppy plant as heroin, and are very addictive. Once a habit is formed, young people often start searching out heroin, which is actually cheaper. Unfortunately, heroin is also the most addictive and deadly drug on the black market and is well known to wreak havoc on the lives of users and their families.

This past week the northern New Jersey newspaper the Bergen Record released a series highlighting problems with heroin in their county. The Record found that, “The majority of heroin-related arrests, overdoses, and deaths reported in Bergen County over the past year were young, white and middle class. Of the 47 non-fatal heroin overdoses reported to the Bergen County Prosecutor’s Office in 2012 — and there were likely more that went unreported — a third were 21 years old or younger. All but nine were under age 30.”

One person interviewed by the Record was “John” from Rockland County. Like many others in the region John drives to heroin-mecca Paterson, New Jersey. “Kids get bored,” John, a 20-year-old, told the Record. “A huge factor is boredom.”

He has already been arrested but that hasn’t stopped him. Like Chief Moore described, “John” started using pills at age 14, stealing OxyContin from his terminally ill father, and has been using heroin on and off for more than two years.

He lives at home with mom, who doesn’t know about his issues, and even gives him cash when he needs it. He also works a job and most of his money not spent on essentials like food and gas, about $30,000 per year, is funneled into his heroin habit, he said.

Chief Moore said at Tuesday night’s meeting that parents should clear out their medicine cabinets of any potentially addictive substances they are not currently legitimately under prescription to use. The town police sometimes hold a special event allowing residents the opportunity to dispose of such pills safely, no questions asked. Stay tuned for the next announced event, he said.

The defendant did attempt to elude the police when being stopped for traffic violation and warrant investigation. The defendant was taken into custody and arrested, processed and arraigned. He was later released on an appearance ticket returnable June 4, 2013 at 9 a.m. after posting $500 cash bail.

Jean Vilbig, age 50, residing at 6 Cobble Pl., Blauvelt, NY, was arrested for assault in the third degree. The defendant was arrested following an investigation into a domestic dispute. It is alleged that the above defendant did cause a physical injury to a family member during said dispute. The defendant was arrested, processed and released on an appearance ticket returnable June 20, 2103 at 1:30 p.m. in the Stony Point Justice Court.

Jose Reyes Ventura, age 28, residing at156 Coolidge St., Haverstraw, NY, was arrested on May 17, 2013 for aggravated unlicensed operation in the third degree. The defendant was arrested after a vehicle and traffic stop revealed he was operating a motor vehicle with a suspended driver’s license for an insurance lapse. The defendant was arrested, processed and released on numerous traffic summonses returnable June 20, 2013 at 1:30 p.m.

AUO & OPERATING A MOTOR VEHICLE WITH SUSPENDED REGISTRATION
Jennitse M. Gonzalez, age 31, residing at 4 Knox St., West Haverstraw, NY, was arrested on May 15, 2013 for aggravated unlicensed operation in the second degree and operating a motor vehicle with a suspended registration. The defendant was arrested after a patrol vehicle equipped with a license plate reader indicated the vehicle the defendant was operating had a suspended registration. Subsequent to a vehicle and traffic stop and NYSDMV inquiry, it was verified that said registration was in fact suspended for insurance not in effect, and the defendant’s NYSDLIC was suspended x8 for failing to answer summonses. In addition, there were two outstanding bench warrants for the defendant out of the Town of Haverstraw on similar charges filed by the Rockland County Sheriff’s Patrol. The defendant was arrested, processed and issued numerous traffic summonses returnable June 12, 2013 at 1:30 p.m. The defendant posted $100 cash bail and was turned over to the RCSO to face charges on said warrants.

GRAND LARCENY & ISSUING A BAD CHECK

Yoel Silber, age 37, residing at 2 Lynhaven Drive, New City, NY, was indicted on May 17, 2013 by a Rockland County Grand Jury for the crimes of grand larceny in the fourth degree and issuing a bad check (10 counts). District Attorney Thomas P. Zugibe stated that on or about February 6, 2012, the defendant deposited 10 checks into a Provident Bank account drawn upon two Citibank accounts , which he owned and had insufficient funds to cover the checks.  Then, on February 6 and 7, 2012, the defendant was able to withdraw US currency from Provident Bank in an amount greater than $1,000 because of the deposited checks.

ASSAULT & CRIMINAL POSSESSION OF A WEAPON

Alex Sostre, age 46, residing at 358 Roosevelt Avenue, Spring Valley, NY, was indicted on May 17, 2013 by a Rockland County Grand Jury for the crimes of assault in the second degree (two counts) and criminal possession of a weapon in the third degree. District Attorney Thomas P. Zugibe stated that on or about April 23, 2013 at approximately at 12:05 a.m., the defendant approached victim and began to argue with him. During the argument the defendant punched the victim multiple times, pulled out a knife and began swinging the knife at the victim. The victim sustained a large laceration to his left wrist from a knife cut. The victim was treated at a local hospital. The police located the knife and the defendant was later arrested at a different location.

GUILTY OF 45 FELONIES: Members of Violent Drug Ring that Plagued Vast Region from Rockland County to the Capital District and Warren County

NEW YORK – Attorney General Eric T. Schneiderman announced Tuesday the guilty verdicts of three individuals who were convicted of 45 felonies by a jury. Guy Anderson, 40, Jamel Pearson, 36, and Michael Williams, 27, were convicted after a 12-week trial in Albany County Court. One of the men, Guy Anderson, the leader of the drug organization, was convicted of multiple drug-related offenses, including one count of operating as major drug trafficker, which carries a mandatory life sentence.

“Some New York neighborhoods are being destroyed by drugs. My office, with the assistance and collaboration of other law enforcement, is working to keep our streets safer and convict drug traffickers who plague our communities,” said Attorney General Schneiderman. “My office will continue to work with our partners around the state to eliminate violent criminal enterprises like this one and we will put criminals behind bars.”

The guilty verdicts are the result of an 18-month joint investigation by the Attorney General’s Organized Crime Task Force, the New York State Police and the Albany Police Department. The three men, who were convicted Monday night, were charged along with 49 other members of a violent narcotics network who distributed massive quantities of cocaine, heroin and various illegal prescription medications, including Hydrocodone, Oxycodone and Percocet.

The operation transported drugs from New York City to areas throughout the Capital Region, as well as Greene, Orange, Renssealer, Rockland, Saratoga, Schenectady, Ulster and Warren Counties. They also operated in Vermont. The vast majority of the other co-defendants previously pled guilty in the case.

The jury returned verdicts of guilty against Anderson for operating as a major trafficker and conspiracy in the second degree along with 15 other counts. The jury found Jamel Pearson guilty of five counts of criminal sale of a controlled substance in the second degree as well as six other counts. Williams was found guilty of conspiracy in the second degree, among other counts. Anderson and Pearson are both facing life sentences. Williams faces up to 70 years behind bars.

Through the use of extensive electronic and physical surveillance, and the review and analysis of suspects’ cell phone records, in conjunction with other investigative tools, the attorney general’s investigation identified Anderson, Pearson, and Williams as leaders of this conspiracy to distribute illegal drugs. Anderson, Pearson and Williams conspired to transport large amounts of cocaine, heroin, and pills to the Capital Region, where it was divided, broken down and distributed throughout the area and in Vermont.

The investigation was code-named “OGK,” based on the affiliation of some of the defendants, including Jamel Pearson, with a home grown Albany-based street gang called the Original Gangsta Killas. The investigation further revealed that Michael Williams was affiliated with the Bloods, another street gang present in the City of Albany.

According to the attorney general’s investigators, in 1993, a group on the east coast created a gang known as the United Blood Nation. Formed in New York City’s Rikers Island jail, inmates created the group as a way to protect themselves from the Latin Kings, which was the preeminent gang in the jail system at that time. Although the United Blood Nation was born in the prison system, as members were paroled to the streets, they formed the Bloods street gangs on the East Coast emulating the Los Angeles Bloods lifestyle.

The Original Gangsta Killas is considered one of Albany’s most notorious street gangs. The south end-based gang was formerly known as the “Black Gangstas.” Their rivals are predominately a gang from the north-end of Albany called the “Jungle Junkies.”

One of the subjects of this investigation, Richard Gibbs, was murdered in the South End of Albany in November of 2011 by rival gang members. Following that incident and during this investigation, OCTF investigators uncovered a retaliation plot for the murder over court-ordered wiretaps. This enabled investigators to seize a gun that was intended to be used in the retaliation attempt, avoiding further bloodshed.

The guilty verdicts are the result of a joint investigation by the New York State Attorney General’s Organized Crime Task Force, the New York State Police and the City of Albany Police Department, with the assistance of the New York National Guard Counterdrug Task Force, the United States Marshals Service, Rensselaer County Task Force, City of Troy Police Department, and the Bennington (Vermont) Police Department.

The investigation was directed by OCTF Special Investigator Dennis Guiry under the supervision of Special Investigator Williams Charles, Deputy Chief Investigator Gene Black and Chief Dominick Zarella. Detective James Wood and Detective John Monte were the lead investigators from the Albany Police Department, under the supervision of Sergeant Brian Quinn, Sergeant Ed O’Leary, Commander Jeff Roberts, Commander Anthony Ryan and Chief of Police Steven Krokoff. Investigator Robert Giampetti was the lead investigator from the New York State Police, under the supervision of Senior Investigator Matt Probst and Lieutenant Michael Tietz.

The case is being prosecuted by OCTF Assistant Deputy Attorney General Michael A. Sharpe, under the supervision of Deputy Attorney General Peri Alyse Kadanoff and Executive Deputy Attorney General for Criminal Justice Kelly Donovan.

Spring Valley Man Convicted of Knifepoint Robbery

Picture 1Rockland County District Attorney Thomas P. Zugibe announced this week that 30-year-old Andrew Baxter of 37 Memorial Park Drive, Spring Valley, New York was convicted after a jury trial of one count of robbery in the first degree, a class “B” felony; one count of robbery in the second degree, a class “C” felony; and one count of criminal possession of a weapon in the fourth degree, a class “A” misdemeanor relating to a knifepoint robbery in Spring Valley.

On June 26, 2012, Baxter and co‐defendant 32-year-old Paul Giddens of 12 Aeslin Drive, Spring Valley, New York, robbed the Pitstop Deli on South Central Avenue in the Village of Spring Valley, Zugibe said. During a three‐day trial, several witnesses outlined details of crimes. Jury deliberations lasted approximately one hour. Baxter faces a determinate state prison sentence between 10 years and 25 years when he is sentenced on July 22, 2013.

He was remanded to the Rockland County Jail. Giddens was convicted of felony counts of robbery and a misdemeanor count of Criminal Possession of a Weapon in April. Supervising Assistant District Attorney Dominic Crispino prosecuted the case.

schermerhornRachael Schermerhorn, 20-years-old, of 30 Franck Rd. in Stony Point is accused of burglary in the third degree (D-felony), criminal possession of stolen property in the fifth degree (A-misdemeanor) and petit larceny (A-misdemeanor) for allegedly stealing monies out of a locked cash register at her job. Stony Point Police allege the incident occurred at her place of employment on May 10, 2013 after business hours. They arrested her on May 14 and placed her bail at $2,500.

PROMOTING & POSSESSING OBSSCENE SEXUAL PERFORMANCE BY A CHILD
Linton Wright III, age 44, residing at Wilshire Drive, Chestnut Ridge, NY, was indicted on May 22, 2013 by a Rockland County Grand Jury for the crimes of promoting an obscene sexual performance by a child (18 counts) and possessing an obscene sexual performance by a child (18 counts). District Attorney Thomas P. Zugibe stated that on or about and between August 30, 2011 and September 4, 2011, the defendant promoted eighteen videos containing obscene sexual performances by children under the age of 17.  On or about November 14, 2012, the defendant possessed 18 videos containing obscene sexual performances by children under the age of 16.

BURGLARY, ASSAULT & RESISTING ARREST
Matthew Hecht, age 29, residing at 128 Waters Edges, Congers, NY, was indicted on May 22, 2013 by a Rockland County Grand Jury for the crimes of burglary in the second degree, assault in the second degree (two counts) and resisting arrest. District Attorney Thomas P. Zugibe stated that on or about November 7, 2012 at approximately 4:50 p.m., the defendant forced himself into the victim’s home and began to wrestle with the victim. The victim was able to force the defendant out the door but the defendant dragged the victim out with him. The defendant and victim continued to struggle outside the home. The victim sustained a broken rib, injured shoulder and broken tooth. Police officers responded to the struggle and the defendant attacked the officers. One of the  officers sustained an injured knee.

ATTEMPTED ROBBERY, ATTEMPTED ASSAULT & CRIMINAL POSESSION OF A WEAPON
Donovan Jackson, age 16, residing at 20 Orchard Street, Yonkers, NY, was indicted on May 22, 2013 by a Rockland County Grand Jury for the crimes of attempted robbery in the first and second degree, attempted assault in the first degree and criminal possession of a weapon in the fourth degree. District Attorney Thomas P. Zugibe stated that on or about May 6, 2013 at approximately 10:15 p.m., the defendant attempted to rob the victim of his money and cell phone with a box cutter. The victim refused and the defendant attempted to cut him and then punched the victim on the face causing injuries to the victim.

BURGLARY & ATTEMPTED BURGLARY
Michael Jenkinson, age 20, 18 Fred Hecht Drive, Apt. A, Spring Valley, NY, was indicted on May 22, 2013 by a Rockland County Grand Jury for the crimes of burglary in the second degree (9 counts) and attempted burglary in the second degree. District Attorney Thomas P. Zugibe stated that on or about and between April 10 and April 29, 2013, the defendant burglarized nine residences and attempted to burglarize another all located in Nanuet, Town of Clarkstown. The defendant was arrested and questioned when a victim of one of the burglarized homes recognized the defendant.

CRIMINAL POSSESSION OF MARIJUANA
Andre Lewis, age 31, residing at 4059 Bruner Ave., Bronx, NY, and Fabian Solomon, age 27, also residing at 4059 Bruner Ave., Bronx, NY, were indicted on May 22, 2013 by a Rockland County Grand Jury for the crime of criminal possession of marijuana in the first degree. District Attorney Thomas P. Zugibe stated that on or about May 2, 2013 at approximately 11:00 a.m., the defendants were stopped while traveling on Route 202 in Pomona for vehicle and traffic violations. The defendants were found to be in possession of over 10 pounds of marijuana.

SEXUAL ABUSE
Edith Pacheco, age 30, residing at 12 Lafayette Avenue, Suffern, NY, was indicted on May 22, 2013 by a Rockland County Grand Jury for the crime of sexual abuse in the first degree. District Attorney Thomas P. Zugibe stated that on or about December 3, 2012 at approximately 1:15 a.m., the defendant entered the victim’s room. The defendant held down the victim and sexually abused the victim. The defendant then placed her hand over the victim’s nose and mouth impeding the victim’s ability to breath.

RESISTING ARREST & ENDANGERING THE WELFARE OF A CHILD

Jason Rickens, age 31, residing at 19 N. Main Street, Spring Valley, NY, was indicted on May 22, 2013 by a Rockland County Grand Jury for the crimes of assault in the second degree (2 counts), resisting arrest and endangering the welfare of a child. District Attorney Thomas P. Zugibe stated that on or about May 13, 2013 at approximately 11:15 p.m., the defendant refused to comply with orders to stay back as the police officers investigated a domestic assault case in the Village of Spring Valley. The defendant, who was holding his one and a half-year-old son threw a punch at one of the officers which struck another officer in the face. After a struggle, the defendant is place under arrest. As a result of the struggle two officers were injured and treated at a local hospital.

 

TWO CAREER CRIMINALS CHARGED IN VILLAGE OF NYACK DRUG CRACKDOWN

Rockland County District Attorney Thomas P. Zugibe on Wednesday announced that two men have been indicted on drug charges following a two-month undercover investigation into narcotics trafficking in the Village of Nyack.

Picture 1Dominic White, 36, of 18 South Midland Avenue, Nyack, New York has been charged with two counts of criminal sale of a controlled substance in the third degree, class “B” felonies and two counts of criminal possession of a controlled substance in the third degree, class “B” felonies.

 

 

Picture 2Larnell Fortier, 22, of 408 Nyack Plaza Apartments, Nyack, New York has been charged with one count of criminal sale of a controlled substance in the third degree, a class “B” felony, one count of criminal possession of a controlled substance in the third degree, a class “B” felony, one count of criminal sale of a controlled substance in the fifth degree, a class “D” felony and one count of criminal possession of a controlled substance in the fifth degree, a class “D” felony.

District Attorney Zugibe said, “These arrests once again underscore our continuing commitment to end drug-dealing and reduce drug-based violence within the Village of Nyack. We will not allow career criminals like these defendants to pedal their poison and terrorize our communities.”

White is currently on parole for prior drug sales in the Village of Nyack and Fortier is currently on probation for prior drug sales in the Village of Nyack. Both defendants were remanded.

The investigation commenced in March, 2013 when the Rockland County District Attorney’s Drug Task Force, together with the New York State Police CNET Unit, the Town of Orangetown Police Department Detective Bureau, the Rockland County Probation Department and the New York State Parole Division, began the investigation with the goal of identifying street-level, open-air drug dealers operating in the Village of Nyack.

The District Attorney further said that undercover police detectives and New York State Troopers posing as drug buyers arranged to purchase powder and crack cocaine and prescription drugs on several occasions, and were met by the defendants who gave the detectives a quantity of narcotics in exchange for a sum of money.

Rockland County Drug Task Force Director Christopher Goldrick said, “The Drug Task Force, along with the Town of Orangetown Police Department, continues to coordinate with state and federal law enforcement officers, including state probation and parole agencies, to systematically dismantle entrenched street-level dealers who continue to plague Village of Nyack residents and its business district.”

Class “B” Felonies are punishable by up to nine years in state prison and Class “D” Felonies are punishable by up to two and one-half years in state prison.

Nanuet man likely to face a year or so in prison

2fba1fe9654f00c7fb06240e552c1b29 (1)Lawrence Mulqueen, of Nanuet, has already pleaded guilty to federal charges of making death threats to public officials via his Facebook page and was scheduled to appear in Rockland criminal court Wednesday to answer separate state charges against him. Instead, however, he is now set to appear in state Supreme Court on June 19 to answer the third-degree charge of criminal possession of a weapon.

Mulqueen reportedly had a metal knuckle knife in his possession when police officers arrived at his home on February 20. The Clarkstown police were called to his home by his landlord, who was attempting to evict him. Officers also recovered two rifles, two rifle bayonets, a rifle scope, bullet-proof body armor, and 100 rounds of ammunition.

The Nanuet man’s Facebook page was filled with threats against various officials, including Governor Cuomo, Mayor Bloomberg, the Congressional Black Caucus, and supporters of President Obama. Mulqueen plead guilty in District Court on Tuesday to charges of threatening to kill public officials and transmitting threats in interstate commerce.

He faces up to 15 years in prison for the federal, though is expected to only receive two. Maximum punishment for the state charges against him is four years in state prison, a sentence that would run concurrent to his federal sentence. Mulqueen also faces fraud charges for attempting to use food stamps to purchase alcohol and cigarettes.


Crazy in Nyack: Security Guard Ken Carter Allegedly Threatens to Blow Up High School

Kenneth A. Carter, 51, of Central Nyack, was facing disciplinary actions from the school and angrily remarked to a co-worker that he would get his guns and blow the school up. He was taken into custody by police without incident and now faces a felony charge for making a terroristic threat.

It has not been stated what Carter was facing disciplinary charges for, or whether he has been placed on leave or terminated. He was arraigned in Clarkstown Town Court and released on $1,000 bail. He is due back in court on June 17.

PSA from Clarkstown Police Department 

On May 29, 2013 an elderly female from Nanuet became a victim to a larceny scam.  The victim observed two males performing work on her driveway.  The victim did not arrange for this work to be done but thought that maybe another family member made the arrangements.  The men then rang her door bell and requested the payment be made in cash in order to receive a discount.

The victim then drove to her bank with the men following her and withdrew said cash which was in excess of $5,000.  She paid the men for their work and they said that they would meet her back at her residence to give her a receipt.  The men left the area. The work performed was inadequate and substandard.

The Clarkstown Police Department would like to inform seniors to follow some simple crime prevention tips.

·         *  Be wary of contractors who come to your home unsolicited claiming that your home is in need of expensive repair work.

·         *  Never agree to have work done on the spot.

·        *  Get at least two written estimates from licensed contractors prior to the start of any project.

·         *  Do not pay the full amount up front or other unreasonable advance sums.

·       *   Make sure all work to be performed is thoroughly described in your contract.

·         *  Don’t be bullied or pressured.

·         *  Call the police and get a license plate number if a door-to-door contractor won’t take “no” for an answer.

If you are a victim of scam report the incident immediately to the police department. Attempt to get a physical description of the suspect (s) and any vehicle including plate number.

PEDESTRIAN STRUCK AND KILLED IN HILLCREST

On June 3 at about 7:42 a.m. the Ramapo Police Department responded to a pedestrian struck by a vehicle crash on Route 45, just north of Guzzel’s Deli, in the Hillcrest area of the Town of Ramapo, Village of Spring Valley.

A pedestrian was found lying on the shoulder on the east side of the roadway unconscious and unresponsive. Rockland Paramedics and Spring Hill Ambulance responded to the scene to administer advanced life support. The pedestrian, Matais Lopez, 33 yrs. old, of Hillcrest, was pronounced dead at the scene by Rockland Paramedics.

A short distance north of the pedestrian a 2011 Nissan Rouge was pulled onto the east shoulder of Rt. 45. The driver of the Nissan, Rony Pierre, of Spring Valley, NY, appeared to have driven off the main traveled portion of the roadway and struck the pedestrian as the pedestrian walked north along the shoulder of Route 45. Pierre then continued for a short distance before pulling over.

Police said it appears that when Mr. Lopez was struck by the Nissan he was walking northbound on the shoulder and Mr. Lopez was struck to the rear of his body. Mr. Lopez was on the hood of the Nissan for a short period of time before sliding off of the car and landing where he was found by the first responding officers. At this time it does not appear that there was any alcohol or drug involvement on the part of the driver of the Nissan.

Ashlee Pressley, age 24, residing at 3 Paula Ln., New City, NY, was arrested on May 23, 2013 for aggravated unlicensed operation in the third degree. The defendant was arrested after officers investigating a suspicious vehicle determined she was operating  a motor vehicle with a revoked driver’s license. The defendant was arrested, processed and released on numerous traffic summonses returnable July 18, 2013 at 1:30 p.m.

Michael Harris, age 18, residing at 10 Prospect Place, Tomkins Cove, NY, was arrested on May 24, 2013 for unauthorized use of a motor vehicle and unlawful possession of marijuana. The defendant  was arrested after a patrol officer observed the defendant and had prior knowledge of an active arrest  warrant for Unauthorized Use of M.V. Subsequent to his arrest, the defendant was found to be in  possession of a quantity of marihuana .The defendant was arrested, processed, arraigned before the  Honorable William F. Franks. He was remanded to the Rockland County Correctional Facility in lieu of  $500 bail.

Woman Accused of Drugged Driving in Clarkstown

On June 4 at approximately 1 p.m. Jill Blau, 40, from Mahwah, NJ was arrested for alleged drugged driving.

Blau was observed driving a 1999 Infinity on Gerlach Drive, New City, at an extremely slow rate of speed. She was subsequently stopped and upon speaking with officers it was observed she had glassy eyes and slowed speech.

Blau was arrested and transported to Clarkstown Police Headquarters where she submitted to field sobriety tests, which she failed and a drug influence evaluation, results of which are pending.

A search of Blau’s vehicle uncovered several prescription drugs which she did not possess a prescription for. Blau was arraigned in Clarkstown Justice Court before Judge Ugell.

She was released on her own recognizance with a return date of July 8 to answer driving while ability impaired by drugs and criminal possession of a controlled substance 7th, both misdemeanors.

Blau is an employee at Link Elementary School in Clarkstown. On June 5 the district informed the community that a staff member had been arrested, but did not give her name out.
