Trio in stolen car crash on PIP caught after fleeing

A trio of West Harlem men bailed out of a stolen car they’d crashed on the Palisades Interstate Parkway Friday afternoon but were quickly caught, authorities said.

Palisades Interstate Parkway Police got several calls Friday just after 1 o’clock of a speeding black Honda missing one of its tires, Lt. Michael Coppola said.

Moments later, PIP Officer Richard Dey found the crashed car — reported stolen out of West Harlem’s 30th precinct — just north of PIP Exit 4 in Alpine, he said.

AGGRAVATED UNLICENSED OPERATION
Francisco A. Almonte, age 25, residing at 24 First St. Apt. C., Haverstraw, NY, was arrested on April 2, 2013 for aggravated unlicensed operation in the third degree. The defendant was arrested after a vehicle and traffic stop determined that he was operating a motor vehicle while his New York State driver’s license was suspended twice for failing to answer a summons. The defendant was arrested, processed, issued numerous traffic tickets returnable May 2, 2013 at 9 a.m. and released.

AGGRAVATED UNLICENSED OPERATION
Thomas Russo, age 30, residing at 28 Ten Eyck St., Stony Point, NY, was arrested on April 3, 2013 for aggravated unlicensed operation in the third degree and failure to surrender suspended New York State driver’s license. The defendant was arrested after a vehicle and traffic stop determined that he was operating a motor vehicle while his New York State driver’s license was suspended once for administrative action by the New York DMV. The defendant was arrested, processed, issued numerous traffic tickets returnable May 2, 2013 at 1:30 p.m. and released.

SEXUAL CONDUCT & ENDANGERING THE WELFARE OF A CHILD
Nelson Llivisupa, age 38, of Haverstraw, NY, was arrested for course of sexual conduct against child in the first degree and endangering the welfare of a child. The defendant was arrested on a warrant out of Rockland County Court. He is lodged in Rockland County Jail awaiting arraignment. He was due back in court on April 8, 2013.

A Rockland County man, Chaim Gruenzweig, 19, of Airmont, was arrested at John F. Kennedy International Airport and charged with criminal possession of a weapon in the 4th degree on Monday afternoon, April 8. A TSA officer detected a five-inch knife hidden in Chaim’s belt.
According to the TSA, the officer, who was staffing the X-ray machine, called for a closer look at the belt, which was inside the man’s carry-on bag. Upon closer inspection, it was determined that the knife was actually configured as part of the belt’s buckle in an effort to conceal the fact that it was a weapon.
Gruenzweig, who was originally ticketed to fly to Frankfurt, Germany, was arrested on a local weapons charge by Port Authority Police, who also took possession of the belt-buckle knife combination tool. There was no impact to airport operations.
The TSA offered a reminder to travelers, weapons-including belt-buckle knifes–are not permitted in carry-on baggage. Passengers are responsible for the items they bring to the security checkpoint, and TSA’s advice to passengers is to look through bags thoroughly before coming to the airport to make sure there are no illegal or prohibited items. Travelers can be fined up to $11,000 if they are caught with prohibited items at the airport.
Passengers can review the prohibited items list on the TSA homepage or they can download the free MyTSA application from the TSA homepage. The TSA web site and the MyTSA app have a “Can I Bring?” feature that allows users to type in items they plan to bring on a trip to get an explanation of TSA’s security policies for the item, including whether the item can be taken in carry-on luggage through the security checkpoint, packed in checked baggage, both, or neither.

DA’S PRESS RELEASE

imageRockland County District Attorney Thomas P. Zugibe today announced that Daniel Jean-Baptiste (DOB 12/15/43) of 272 Main Street, Spring Valley, New York has been sentenced to 12 years in state prison and five years post-release supervision on his guilty plea to one count of manslaughter in the first degree, a class “B” felony.

District Attorney Zugibe said, “The defendant has been sentenced for the taking part in cold-blooded killing more than 18 years ago. This was a senseless killing that left a family and a community without closure. After so much time, I am happy to say that justice has finally been done.”

On October 20, 1994, at approximately 8:30 p.m., Zugibe said Jean-Baptiste assisted in causing the death of Rene Charles. The victim, a real estate broker and well-known activist in the local Haitian community, was shot twice in the back and once in the right side at close range with a .38 caliber handgun in the driveway of his Spring Valley home.

Detectives with the Spring Valley Police Department arrested the defendant on December 21, 2011. He was subsequently charged with murder in the second degree, a class “A-1” felony for acting with another person to bring about the death of Charles. Jean-Baptiste’s role in the homicide was to drive the second person to the victim’s home; he was not the actual shooter. After Charles was killed, the defendant returned to pick up the triggerman, both of whom fled before police arrived.

Jean-Baptiste pled guilty on January 17, 2013 during jury selection for his impending trial. The plea agreement was reached with the consent of the victim’s family, which sought closure after 18 years. Executive Assistant District Attorney Stephen Moore prosecuted the case.

PETIT LARCENY & CRIMINAL POSSESSION OF STOLEN PROPERTY
austinsuazoShevette Austinsuazo, age 25, residing at 55 Broadway, Apt. 2B, Havertraw, NY, was arrested on April 6 for petit larceny and criminal possession of stolen property in the fifth degree. The defendant was arrested following an investigation into a shoplifting complaint at the ShopRite of Stony Point where she is accused of stealing assorted grocery items and possessing same. The defendant was arrested, processed and issued an appearance ticket returnable in Stony Point Justice Court on May 16, 2013 at 1:30 p.m.

reinigKaren C. Reinig, age 58, residing at 14 Mtn. View Mobile Home Pk., Stony Point, NY, was arrested on April 7 for driving while intoxicated and numerous vehicle and traffic violations. Stony Point Police arrested the defendant after investigating an auto accident in which the vehicle and operator attempted to leave the scene. Investigation determined the defendant was operating a motor vehicle while in an intoxicated condition. The defendant was arrested, processed and released on an appearance ticket returnable on April 18, 2013 at 1:30 p.m.

DWI, OPEN CONTAINER OF ALCOHOL IN VEHICLE & AUO
linenRonnie Linen, age 52, residing at 30 North Park Dr., Garnerville, NY, was arrested on April 6 for driving while intoxicated, driving while intoxicated per se, aggravated unlicensed operation, open container of alcohol and numerous vehicle and traffic offenses. Stony Point Police arrested the defendant after a vehicle and traffic stop determined that the defendant was intoxicated and was driving in excess of .08 BAC. The charges were upgraded to a felony due to a previous conviction for DWI within the last ten years. The defendant was also operating with a suspended driver’s license and with an open container of alcohol in the vehicle. The defendant was arrested, processed and released on an appearance ticket returnable April 16, 2013 at 1:30 p.m.

FAILURE TO PAY CHILD SUPPORT
David Encarnacion, age 29, of Haverstraw, NY, was arrested on outstanding Family Court warrant issued on March 8, 2013 by Rockland County Family Court Judge Warren for failure to pay child support. The subject was brought before Judge Warren to answer for arrears due private petìotioner of$5,754.20 and the Department of Social Services of $1,497.60. A return court date was scheduled for April 9, 2013.

UNLICENSED OPERATION
Joanne Sarter, age 61, of Suffern, NY, the arrest of Joanne Sarter on a Warrant out of Ramapo Court for unlicensed operation and violation of miscellaneous rules. The subject was arraigned by the Honorable Judge Simon and released after posting $150 bail with a  date to return to court.

BURGLARY
Tyler Rivera, age 21, of Nyack, NY, was arrested for burglary in the third degree on an arrest warrant issued out of Rockland County Court on Burglary charges. He was due back in court on April 16.

FAILURE TO PAY CHILD SUPPORT
Erwin Bustamante, age 32, of Congers, NY, was arrested on April 12 on an outstanding Family Court warrant issued on April 5, 2013 by Rockland County Family Court Judge Eisenpress for failure to pay child support. The subject  was brought before Judge Warren to answer for arrears of $10,864.83 owed to the  Department of Social Services. He was released to return at a later date.

The bad doctor is on trial at this time and potentially faces the death penalty for his alleged misdeeds. Evidence introduced in court indicates that Gosnell would regularly induce the birth in late-term pregnancies and then murder the viable child which lay defenseless on his table.

A common technique used in Gosnell’s alleged practice of “post-birth abortion” was the stick a scissor into the back of the neck of the child and to cut its spine.

Gosnell’s clinic was described as filthy, with body parts of fetuses floating in formaldehyde jars throughout his offices. He is charged with eight counts of murder; seven first-degree charges for deaths of newborns and one third-degree charge for the 2009 death of a 41-year-old Bhutanese refugee.

He is also charged with performing abortions beyond the 24-week maximum, running a corrupt organization and other charges.

CONVICTION IN SPRING VALLEY KNIFEPOINT ROBBERY

Zugibe this week announced that 32-year-old Paul Giddens of 12 Aeslin Drive, Spring Valley, New York was convicted after a jury trial of one count of robbery in the first degree, a class “B” felony, two counts of robbery in the second degree, class “C” felonies, and one count of criminal possession of a weapon in the fourth degree, a class “A” misdemeanor.

On June 26, 2012, Giddens and a co‐defendant robbed the Pitstop Deli on South Central Avenue in the Village of Spring Valley. During a three‐day trial, several witnesses outlined the details of knifepoint robbery. Jury deliberations lasted approximately 10 minutes.

The defendant faces a determinate term of 10 to 25 years in state prison when sentenced on June 18, 2013. Giddens was remanded to the Rockland County Jail. Supervising Assistant District Attorney Dominic Crispino and Senior Assistant District Attorney Janine Kovacs prosecuted the case.


Update on attempted murder/suicide case in New City

The Clarkstown Police Department’s Detective Bureau has concluded its investigation into the assault of a 7-year-old girl and the death of her mother which occurred on February 28 at 6 Quarry Dr, New City.

The investigation concludes that Victoria Vovchik acted on her own and is solely responsible for stabbing her 7-year-old daughter numerous times and then successfully committing suicide.

The investigators concluded that a follow-up interview of the victim would produce no additional evidentiary information. Therefore, in consultation with her health care providers, the victim was not interviewed as it would cause unnecessary additional trauma.

A CPD press release stated, “On behalf of Chief Sullivan and the Clarkstown Police Department, we extend our deepest sympathies to the victim, her family, friends, and all that were affected by this tragic incident.”

GRAND LARCENY
Anthony Giannattasio, age 27, residing at 551 Avalon Gardens Drive, Nanuet, NY, was sentenced April 17, 2013, before New York State Supreme Court Justice William A. Kelly to a state prison term of 3-9 years after pleading guilty to grand larceny in the second degree. District Attorney Thomas P. Zugibe stated that on or about and between March 1 and September 30, 2011, the defendant is a personal banker who befriended an elderly couple and then stole their money. The defendant obtained an ATM card for the couples’ Chase bank account and withdrew a total of $82,560 from April to September, 2011.

ARSON
Jonathan Barillas, age 16, residing at 38 South Franklin St., Nyack, NY, was sentenced April 17, 2013, before New York State Supreme Court Justice William A. Kelly to a state prison term of 2-6 years after pleading guilty to arson in the third degree. District Attorney Thomas P. Zugibe stated that on or about and between August 10, 2012 and August 13, 2012, the defendant knowingly entered a business located at 13 Catherine Street, Nyack without permission and authority, and stole property, including a computer keyboard. On or about August 21, 2012, the defendant intentionally set fire to four separate parked vehicles located in a two-block radius in downtown Nyack. One of the vehicle fires at 35 Summit Street spread to the residential home, causing damage. When the defendant was arrested, he was in possession of a Shell credit card in the name of Avon Cooper, which he stole, without permission, from a vehicle.

BURGLARY
Troy Webber, age 37, residing at 167 Perry Street 1Q, NY, was indicted on April 17, 2013 by a Rockland County Grand Jury for the crime of burglary in the third degree. District Attorney Thomas P. Zugibe stated that on or about March 12, 2013 at approximately 12 a.m. to 9:30 a.m., the defendant entered the Sportsview Bar located on Wayne Avenue in the Town of Stony Point through a window. While in the bar, the defendant took approximately $320 from the cash register and draw under the register.

CRIMINAL CONTEMPT
Grevon James, age 35, residing at 265 South Little Tor Road, New City, NY, was indicted on April 17, 2013 by a Rockland County Grand Jury for the crimes of criminal contempt in the first degree. District Attorney Thomas P. Zugibe stated that on or about October 25, 2012, at approximately 10:03 p.m., the defendant grabbed the neck of the victim, causing redness to her neck, in violation of an order of protection issued by the Clarkstown Justice Court and in effect from August 15, 2012 through August 14, 2013.

BURGLARY
Jayquan Boone, age 20, residing at 56 Spring Valley Commons, Spring Valley, NY, was indicted on April 17, 2013 by a Rockland County Grand Jury for the crimes of burglary in the second degree (five counts) and burglary in the third degree. District Attorney Thomas P. Zugibe stated that on or about and between February 12, 2013 and March 24, 2013, the defendant unlawfully entered into five different residences and stole property consisting of televisions, jewelry and computers.

GRAND LARCENY & CRIMINAL POSSESSION OF STOLEN PROPERTY
Edward Jimenez, age 55, residing at 721 White Plains Road, Bronx, NY, was indicted on April 17, 2013 by a Rockland County Grand Jury for the crimes of grand larceny in the fourth degree (two counts) and criminal possession of stolen property in the fourth degree (two counts). District Attorney Thomas P. Zugibe stated that on or about February 7, 2013 at approximately 5 p.m. in the Target Store located at 50 Spring Valley Marketplace in the Village of Spring Valley, the defendant selected 2 Dyson vacuums and left the store through the fire door without paying for the items. The defendant was not apprehended on February 7, 2013 and the vacuums were never recovered. On or about February 20, 2013 at approximately 9:45 p.m., the defendant returned to the Target Store located at 50 Spring Valley Marketplace in the Village of Spring Valley. The defendant again selected two Dyson vacuums to steal by walking toward the fire door of the store with the vacuums. The defendant saw that security was watching him so, after passing all payment points he ran out of the store without the vacuums and was arrested shortly thereafter.

CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE
Clinton Morris, age 45, residing at 87 East Front St., Hancock, NY, was indicted on April 17, 2013 by a Rockland County Grand Jury for the crimes of criminal possession of a controlled substance in the fourth degree and seventh degree. District Attorney Thomas P. Zugibe stated that on or about April 6, 2013 at approximately 12:15 a.m., the defendant was a passenger in a vehicle traveling on the NYS Thruway in the Town of Clarkstown. The vehicle was stopped by a State Trooper for speeding and moving from lane unsafely. After a search, the defendant was found to be in possession of approximately 6.5 grams of cocaine.

BURGLARY, CRIMINAL POSSESSION OF STOLEN PROPERTY & GRAND LARCENY
Jaime Tovias-Umana, age 19, residing at 14 Island Road, Ramsey, NJ, was indicted on April 10, 2013 by a Rockland County Grand Jury for the crimes of burglary in the second degree, criminal possession of stolen property in the fourth degree and grand larceny in the fourth degree. District Attorney Thomas P. Zugibe stated that on or about March 25, 2013 at approximately 4:34 a.m., the defendant entered a residence where the homeowners were present and asleep. The homeowner woke up when he heard a door open and confronted the defendant. The homeowner detained the defendant until the police arrived. The homeowner recovered several items from the defendant’s pockets, including a wallet containing credit cards.

DRIVING WHILE INTOXICATED
Nathan Watson, age 46, residing at 39 Catamount Drive, Spring Valley, NY, was indicted on April 17, 2013 by a Rockland County Grand Jury for the crime of driving while intoxicated, as a felony (two counts). District Attorney Thomas P. Zugibe stated that on or about October 4, 2012 at approximately 11:00 p.m., a member of the Spring Valley Police Department was alerted to an accident at the Super Value Gas Station located on North Main Street in the Village. The officer observed the defendant to be in an intoxicated condition. The defendant had slurred speech, glassy eyes and an odor of alcoholic beverage. The defendant’s blood alcohol content was .11%. The defendant had a previous DWI in 2005 in the Town of Clarkstown.

BRIBE RECEIVING, FALSIFYING BUSINSS RECORDS & MORE
Hulen Ginn, age 41, residing at 11 Bee Street, Valley Stream, NY, was indicted on April 10, 2013 by a Rockland County Grand Jury for the crimes of bribe receiving in the third degree (five counts), receiving a reward for official misconduct in the second degree (five counts) and falsifying business records in the second degree (five counts). District Attorney Thomas P. Zugibe stated that on or about June 8, 2012 to October 17, 2012, while employed by the Rockland County Road to Recovery DTAP program, the defendant solicited and accepted bribes in return for getting DTAP participants out of the program early or allowing them to avoid attending the half-way house requirement of their DTAP agreement. The defendant was arrested on October 17, 2012 after an investigation by the Rockland County District Attorney’s Office. He was arraigned before the Hon. John Grant of the Town of Haverstraw Justice Court. He was released after posting $10,000.00 bail pending future court appearances.

ATTEMPTED ARSON, BURGLARY & CRIMINAL MISCHIEF
Sergey Zavalko, age 45, residing at 2033 Route 208, Montgomery, NY, was indicted on April 19, 2013 by a Rockland County Grand Jury for the crimes of attempted arson in the third degree, burglary in the third degree and criminal mischief in the second degree. District Attorney Thomas P. Zugibe stated that on or about October 27, 2012, the defendant broke into a church located on West Church St., in the Village of Spring Valley ad stole multiple candles. The defendant lit the candles and threw them thru the second floor window and into building. The defendant also threw a container with combustible liquid into the building. The defendant was detained until the police arrived.

ROBBERY
Ruben Joseph, age 17, residing at 10 Chestnut Street, Suffern, NY, was indicted on April 19, 2013 by a Rockland County Grand Jury for the crime of robbery in the first degree. District Attorney Thomas P. Zugibe stated that on or about November 3, 2012 at approximately 7:40 p.m., after the victim gave defendant a cab ride to Central Nyack, the defendant put a knife to the victim’s neck and stole the victim’s cellular telephone.

DWI & AUO
William Salguero, age 35, residing at 36A Bridge Street, Newburgh, NY, was indicted on April 19, 2013 by a Rockland County Grand Jury for the crimes of driving while intoxicated, as a felony, and aggravated unlicensed operation in the first degree. District Attorney Thomas P. Zugibe stated that on or about February 23, 2013 at approximately 6:10 a.m., a NYS Trooper observed the defendant’s car stopped on the shoulder and the defendant was behind the wheel of the vehicle. Upon further investigation, the trooper observed the defendant to be in an intoxicated state. The defendant failed various field sobriety tests and his blood alcohol content was .14%. The defendant’s NYS driver’s license was suspended for prior DWI convictions.

CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE & UNLAWFUL POSSESSION OF MARIJUANA
William Smith, age 34, residing at  220 East St, Apt. 11A, NY, Denyco Gonzalez, age 22, residing at 307 W. First Street, Elmira, NY, and Quen Rosario, age 21, residing at 375 East Center St., Elmira, NY, were indicted on April 19, 2013 by a Rockland County Grand Jury for the crimes of criminal possession of a controlled substance in the third degree (two counts) and fourth degree and unlawful possession of marijuana (two counts). District Attorney Thomas P. Zugibe stated that on or about April 4, 2013 at approximately 2:30 p.m., the defendant’s vehicle was stopped for traffic and vehicle violations while traveling on the NYS Thruway in the Town of Ramapo. The defendants were found to be in possession of cocaine and marijuana.

Six years in stir for local pusherman

arrested7-1Emmanuel “Dough Boy” Quezada, age 29, of 145 Broadway, Haverstraw, was sentenced to six years in state prison this week by Rockland County Court Judge William K. Nelson. He pled guilty to criminal possession of a controlled substance in the 3rd degree after being found with 10 ounces of cocaine.

District Attorney Thomas P. Zugibe stated that on or about March 21, 2012 at approximately 6:25 p.m., a NYS Trooper observed a vehicle with tinted windows and an illegal sticker on the rear window operating on the NYS Thruway in the Village of Nyack. The defendant was the passenger of the vehicle and the trooper observed the odor of burnt marijuana emanating from the vehicle. A search of the vehicle revealed a small amount of marijuana and a dagger. At the police station, the defendant was found to be in possession of approximately 10 ounces of cocaine in his waistband.

At the time of his arrest Zugibe said Quezada was one of the most important drug busts of 2012. Quezada is a repeat violent felon and, according to authorities, a long time major source of illegal narcotics for Rockland County. Zugibe said that Dough Boy’s criminal record includes prior arrests for criminal sale and criminal possession of controlled substances, along with assault, robbery, sodomy, bail jumping and child endangerment.

Two Rockland Businesses Charged with Selling Tax-free Smokes

Statewide “roll-your-own” investigation yields 10 arrests including two in Rockland County
The New York State Department of Taxation and Finance Thursday announced the arrest of 10 individuals in the Capital District and Hudson Valley regions for illegally possessing untaxed cigarettes and untaxed tobacco.
The 10 – all employees or owners of roll-your-own (RYO) cigarette outlets – are alleged to have possessed quantities of pre-rolled, untaxed cigarettes that were to be offered to the general public for sale, in violation of the New York State Tax Law. There were no immediate arrests at two of the twelve locations raided, though evidence was seized at those stores.
Earlier this year, undercover investigators with the Tax Department made purchases of untaxed, pre-rolled cigarettes at each of the twelve locations at issue.
Because cigarette taxes were not prepaid as required, these shops were able to sell cigarettes for as low as $35 a carton.  When sold legally, cigarettes can cost as much as $100 a carton for premium brands.
“Avoiding taxes gives unscrupulous merchants an unfair advantage over business owners who comply with their tax responsibilities,” said Commissioner of Taxation and Finance Thomas H. Mattox.
The ten individuals arrested were charged with crimes for the illegal possession of untaxed cigarettes for the purpose of sale, and/or possessing untaxed tobacco.
The ollowing are the locations of the stores busted in Rockland County, items seized and individuals arrested (including charges):

  1. Tobacco House of C & W, 10 Orangetown Shopping Center, Orangeburg; two RYO machines, 104 cartons of untaxed cigarettes, 100 pounds of untaxed tobacco and $3,221 in cash seized; Bao Chai Wang charged with one class E felony and one class A misdemeanor
  2. Tobacco House of O.Y., 144 Ramapo Road, Garnerville; two RYO machines, 11 cartons of untaxed cigarettes and $7,122 seized; Xiu Ming Liu charged with one class A misdemeanor

Richard Gooler, age 25, residing at 95 Grassy Point Rd., Stony Point, NY, was arrested on April 22, 2013 for assault in the third degree. The defendant was arrested after he turned himself in on an active bench warrant for the listed charge. The defendant was arrested, processed, arraigned and released on an appearance ticket returnable May 16, 2013 at 1:30 p.m. after posting $250 cash bail.

UNLAWFUL POSSESSION OF MARIJUANA
Kenneth Solomon, age 20, residing at 401 Willow Grove Rd. Stony Point, NY, was arrested on April 20, 2013 for unlawful possession of marijuana. The defendant was arrested after a vehicle and traffic stop revealed that he was in possession of marihuana. Thomas Starr, age 36, residing at 662 Western Hwy., Blauvelt, NY, was arrested on April 9, 2013 for operating a motor vehicle with a suspended registration. The defendant was arrested after a patrol vehicle with a license plate reader revealed that the vehicle the defendant was operating had a suspended registration. Further DMV inquiry verified said suspension. The defendant was arrested, processed and released on numerous traffic summonses returnable May 16, 2013 at 1:30 p.m.

CRIMINAL TRESPASS UNLAWFUL POSSESSION OF MARIJUANA
harris 2Michael J. Harris, age 18, residing at 10 Prospect Place, Tomkins Cove, NY, was arrested on April 19, 2013 for criminal trespass and unlawful possession of marijuana. The defendant was arrested after officers responded to an abandoned residence on Park Rd. in the Town of Stony Point and found him hiding inside said location. Further investigation revealed that he was also in possession of 4.6 grams of marijuana at the time of his arrest. The defendant was arrested, processed and issued an appearance ticket returnable May 16, 2013 at 1:30 p.m.

The defendant was arrested after he turned himself in on an active bench warrant for the listed charge. Clarkstown PD investigating burglaries on Springbrook and Pascack Roads

NEW CITY – A number of residential break-ins in the vicinity of Springbrook and Pascack roads in Nanuet have Clarkstown Town Police concerned and they are seeking assistance from town residents in observing crime prevention habits before leaving their homes unattended.

Most of the recent burglaries have occurred during daytime hours, possibly late morning to noon with entry gained mostly through the rear of the house by either using an unlocked door or by forcing the door. Stolen items have included small electronic items, cash and jewelry.

Police advised residents to make sure all windows and doors are locked and secured. All outside doors should be solid and have a double dead bolt lock. Hedges and brush that could obstruct the view of entry points should be trimmed back and burglar alarms should be activated before leaving and valuables, including cash and jewelry should be hidden.

Victims of burglaries are advised to report them to the police immediately.

PRESS RELEASE FROM RAMAPO PD

On April 25 at approximately 7:39 p.m., Ramapo Police responded to Fresh Cuts Barber Shop 316 N. Main St., in the Hillcrest section of the Town of Ramapo for a reported assault.

Upon arrival, Ramapo Police Officers found a 47-year-old male who stated that he had been stabbed inside the barber shop.  The victim, of Spring Valley NY, suffered a non-life threatening chest wound.  He was transported to Good Samaritan Hospital by Spring Hill Ambulance.  Rockland Paramedics assisted at the scene.

Investigation at the scene revealed that Franklin Desamours, age 54, of New Hempstead NY had stabbed the victim with scissors while inside the barber shop.

Desamours was charged with Assault in the second degree, a Class D Felony, Criminal Possession of a weapon in the fourth degree, a Class A Misdemeanor, and Menacing in the second degree, a Class A Misdemeanor.

At the time of this press release, he was being held at the Town of Ramapo Police Department awaiting arraignment.

 


Trustee Watson Charged with Contractor Fraud

Village of Haverstraw Trustee Thomas Watson, 39, of 99 Maple Avenue, Haverstraw, New York has been charged with one count of grand larceny in the third degree, a class “D” felony, pertaining to an alleged act of contractor’s fraud. Watson also goes by the name Terence Watson.

Watson, a licensed home improvement contractor who conducts his business under the name Watson Contracting and Home Improvement, is alleged to have stolen over $10,000 from a Clarkstown homeowner with whom he had contracted to perform renovations.

According to the charges, the victims ‐ a young, married couple ‐ contracted with the defendant after securing a government‐backed loan for the purchase of the home in New City. The loan was contingent upon completion of certain repairs to the property.

The victims paid Watson $14,000 ‐ one‐half of the total cost ‐ in June, 2012, with the balance due by the completion of job, which was promised by late August.

It is alleged that the defendant started the remodeling work in September, well behind schedule, while only making irregular appearances at the home.

By October, 2012, Watson allegedly walked away from the job. All attempts by the victims to have money refunded and to procure an accounting of what renovations were completed were allegedly ignored by the defendant.

Watson is accused of abandoning the project and failing to provide an accounting or return of the victim’s money.

The arrest of the defendant resulted from an investigation conducted by the Rockland County Special Investigations Unit and the Rockland County Department of Consumer Protection.

In 2012 the Rockland County Times investigated a similar allegation against Watson. The trustee had been stalling on a project he was paid to undertake on Maple Avenue  according to the Glass family, whom contracted him.

Only when Watson learned a feature on the situation was about to run in the newspaper did he take action. He blamed the homeowner for the delay, claiming she had not filed needed paperwork.

The defendant will be prosecuted for grand larceny through application of the New York State Lien Law, which mandates that, upon acceptance of funds in connection with a contract for improvement of real property or home improvement, those funds become a trust, which can be used only to pay for costs incurred in the performance of that homeowner’s project. The use of that money for any other purpose is a larceny under the Lien Law. Further, the contractor must maintain separate ledgers for each job for which he has contracted.

By failing to provide an accounting of how the money had been used and by not returning the money upon the demand of the consumer, the contractor is accused of violating both the Penal Law and the Lien Law.

The defendant was arraigned today in the Clarkstown Justice Court before the Honorable Howard Gerber and released on his own recognizance.

Watson is due to return to court on May 29, 2013. If convicted, the he faces a possible state prison sentence of up to seven years.

Supervising Senior Assistant District Attorney Anthony Dellicarri is prosecuting the case.

CLARKSTOWN PD TRACK DOWN FUGITIVE FROM MISSOURI

glackinOn April 30 at approximately 5:05 p.m., Robin Glackin, 57, from St. Louis, MO was arrested as a fugitive from justice.

Glackin had an active arrest warrant from the state of Missouri for burglary, possession of a switchblade knife, and driving while revoked. Clarkstown Police received information that Glackin was possibly staying at a residence on Norwood Place in Nanuet.

Officers responded to the location and found Glackin. Glackin was placed under arrest and transported to Clarkstown Police Headquarters where he is pending arraignment on a fugitive from justice charge. The state of Missouri will seek extradition of Glackin.

Fourteen accused in $229,000 child care fraud bust

Rockland County District Attorney Thomas P. Zugibe, joined by Rockland County Executive C. Scott Vanderhoef and Susan Sherwood, Commissioner of Social Services, last week in announcing that 14 individuals face charges of illegally obtaining subsidized child care funds. The defendants allegedly fraudulently obtained child care subsidy payments from the Rockland County Department of Social Services by submitting false information to receive the benefits meant to provide child care for needy families. Twelve of the defendants have been formally charged and two are presently being sought.

According to the criminal charges, the 14 defendants – who range in age from 25 to 42 – allegedly falsified applications submitted to the Rockland County Department of Social Services between 2007 and 2011, making it possible for each to receive child care subsidies. The total amount allegedly stolen from taxpayers exceeds $ 229,000.

District Attorney Zugibe said, “These defendants are accused of cheating the system by fraudulently receiving payments from a program designed to provide benefits to the disadvantaged. With so many low-income families truly in need of child care support, my office will aggressively pursue those who use deceit and fraud to feign a need for public benefits.”

County Executive Vanderhoef said, “As a result of the County Department of Social Services ongoing commitment to child care fraud prevention, and detection, and their close partnership with District Attorney Thomas Zugibe’s office, individuals who fraudulently obtain public assistance need to know they face swift and certain prosecution in Rockland County.”

Child care subsidy fraud takes many forms, including concealing true income in order to qualify for the program, falsely representing children in the home eligible for the program when the children are, in fact, living elsewhere and reporting someone as a child care provider when, in fact, that person is not providing child care services.

In one instance, the county paid $3,642 to help defray day care costs for Barbara Jordan, 25, and Dion Wilfong, 30, of 175 Fred Hecht Drive, Spring Valley, New York. The defendants allegedly scammed the system by claiming that Wilfong was an uncle to his own child in order for him to obtain DSS payments for watching the child.

The defendants are variously charged with Grand Larceny in the Third Degree, a class “D” Felony and Welfare Fraud in the Third Degree, a class “D” Felony. (See Addendum for further details) If convicted, they each face up to four years in prison.

The countywide sweep of alleged fraudsters is the result of a one-year, $60,000 Child Care Fraud Prevention and Detection Incentive Program Grant from the New York State Office for Children and Family Services. (OCFS)

Some of the defendants accused of stealing child care subsidies were also allegedly receiving food stamps and other public assistance to which they were not entitled.

Child care fraud may exist when an applicant for, or recipient of, child care services deliberately provides the County Department of Social Services with false or incomplete information or omits information on such data as household composition, household income, the need for child care services, address, etc. to receive or retain child care services to which they are not legally entitled to receive.

Child care fraud may also exist when a provider of child care services deliberately falsifies or alters attendance records to mark a child present who is not and bills the Department of Social Services for services not rendered; shares child care subsidy monies with the recipient; and/or charges the Department of Social Services more when caring for a child whose family receives a child care subsidy than the provider charges members of the general public.

“Child care subsidy funding is limited,” said Susan Sherwood, Commissioner of Social Services. “Every fraudulent dollar spent means there is one less dollar that can go to an increasing number of eligible families who rely on this subsidy so they can go to work.”

Approximately $9 million will be spent on child care subsidies for fiscal year 2013 in Rockland from federal, state and local funding sources. As of December, 2012, there were 714 families receiving subsidies for 1,590 children and approximately 867 eligible families on a waiting list. The waiting list affects income-eligible families earning less than 200% of the poverty level but earning too much to receive Temporary Assistance.

New York’s child care subsidy program is a state-supervised program that’s administered locally by the state’s 58 social services districts. OCFS works with its partners to help identify and prevent fraud, waste and abuse in the program.
